Capital One appealed FOS now waiting for Final Ombudsman Decision

Hi All
I tried to claim back PPI from Capital one in January 2012, they basically said no we are not paying you back so I took it to the FOS who then in August 2012 said that they thought Capital One should uphold my complaint. Capital still said no and since October 2012 i have been waiting on a final decision from the Ombudsman. As it has been 12 months now now waiting I called FOS and they said they cannot tell me when this will be resolved!!! This is ridiculous, does anyone know how long the final decision from an Ombudsman takes? Much appreciated if you have gone through a similar experience it would be great to see how and when yours was resolved?

18-36 months typically.
Most cap one complaints at the FOS fail. So, if yours was initially upheld by an adjudicator that would be unusual in itself. So, cap one are probably concerned as to why it was upheld. There are only a small number of ombudsman. The PPI issue has flooded them. There are more than there used to be but you can see them listed on their website.
Historically, the FOS tended to have investments or pensions as the main areas of complaint they looked at. However, if you look at the most recent complaint stats you will find that they got 378,699 over the year on PPI. Compare that to 370 complaints on unit linked funds or 1808 on pensions for the same period. Nowadays it is PPI that is the standout product but also current accounts, mortgages and credit cards that dominate the complaints stats.

Yes. Quote to the FOS case 1179-4709 or 1315-0135. Both had final decisions in about a month after being queued up for determination recently.0 -

It took my complaint a month to have a determination made after being in a queue for over a year for an Ombudsman.urs sinserly,

Mine was 6 months waiting for an Ombudsman, one month for a provisional decision and one month for a final decision.0

Normally about 18-24 months after the adjudicator decision.I am thinking of going to the press or a solicitor???
If you go to a solicitor and start legal action then the FOS will have to cease its review. So, that would be counter productive.
Going to the press will not help as there is no reason why you should be entitled to jump the queue ahead of all the others waiting for a decision. Its not a case of it being unfair to you but just a reality of extreme volume and not enough to cope with it.I am an Independent Financial Adviser (IFA). Expensive and very unlikely to either speed things up or improve your chances of success.or a solicitor???

You could do either of your suggestions or even quote the case numbers above to the FOS.... and loose you case. Depends where your priority is.0
