Help, Claim in dispute but also need to renew insurance...

I'm trying to help my FIL to sort his car insurenace - ATM he is paying an silly amount. His insurenace is due for renewal on 23rd June so I am trying to get some quotes. However, he is currently disputing a claim which was made against him for an incident in January. It seems that his Son (BIL not my hubby LOL), who uses the car during the day has hit someone and they are claiming against FIL insurance. BIL is covered by his own insurance not FIL, so we are currently disputing this with FIL insurance co - I think the claim should be made angainst BIL insurance (I think BIL has been sneaky - he didn't tell FIL about the claim until the insurance co had contacted FIL about it).

Anyway, my question is, can we get quotes stating his no claims bonus with this claim being in dispute? Will we have to declare this claim until it is sorted out with FIL/BIL insurance companies?

Did your FIL protect his NCD?

Is your BIL a named driver on your FIL's policy or was he driving it third party under his own cover?

Yes, you do have to declare the open claim when getting quotes.

    thanks raskazz,

FIL NCD is not protected. BIL was not named on FIL policy, he was driving onhis own insurance.

    thanks raskazz,

FIL NCD is not protected. BIL was not named on FIL policy, he was driving onhis own insurance.

Doesn't necessarily cover him and certainly does not cover your FIL. To explain -

Many motor policies used to have an extension that let you drive a car belonging to someone else (with permission) but with Third Party cover only.

So if your BIL managed to mangle your FIL's car, there would be no payment made by any insurer - BIL would have to pay for repairs out of own pocket. Does FIL realise this?

The extension has now been removed by many insurers due to abuse. People were insuring Fiesta's but borrowing mates Audi's etc to avoid the high premiums.

You need to check BIL's insurance policy. If he has the extension then the third party claim should be passed to BIL's insurers.

If not, and he is not a named driver on FIL's policy, then strictly speaking, the car was uninsured.
