Hit from behind while Stationary

Today I was hit from behind while parked at a junction :mad: . The person in the other car admitted fault to me and gave me their details. I have rung my insurance to make a claim. Am I going to have to pay my excess or will their insurance cover it all? It is obvious to me that it was his fault but I am aware that soemtimes when faced with paying up people try and claim all sorts of things and I can not afford to claim and pay the excess!

    happened to me years ago my car was stationary at the scene of an accident and someone came round the corner too fast and i didnt have to pay my excess when i got the check after the car had been written off although the insurance co accepted responsibility on the othern drivers behalf

    Ok thanks. A friend of mine has told me that Insurance companies never dispute liability if someone is hit from behind as it is always the fault of the person behind as they should have left a safe distance or been aware that the person ahead was stopped. I don't know if this is true but it sounds fair to me.

    Would I have to pay the excess in advance and claim it back?

    It is true that rear end shunts are always the fault of the person doing the shunting. Some try to muddy the waters by suggesting the car in front was reversing but this is uncommon.

    Normally you pay the excess and claim it back off the other persons insurers. Some insurers do this for you, Direct Line for one I believe.

    I've never had to pay the excess when it has been the other persons fault, not even pay it and claim it back. You should be okay. I've had people go into me when I was with Lloyds TSB and M&S (Fortis). The last time was 13 days ago! My car was parked and unattended outside where I was staying - thankfully the person who did it came to find me.
