bus lane ticket for taxi

  • only court bailiff's have any power and since its not been to court.... and if it does go to court it is then in dispute and the bailiffs cant do any thing till it is dealt with.


    if my car (plate in boot) was caught on camera going through a bus lane and I was smoking. according to the council I would be quilty of two offences, any one see my point now .....


    I know I have said I will not pay, BUT if the council can clear up when the plate is in the boot is the car licenced or not, then it will be worth £60 to allow any one to drive or smoke in my car when the plate is in the boot.


    their are only three ways for my car to cease being a private hire
    1 licence runs out


    2 council put a stop notice on my car for one reason or another


    3 I hand my plate back either permanently or for a short period of time I.E suspend it, but then my P/H insurance is no longer valid as my car is not licenced

    Looking on the bright side now they've done away with the bus lanes you're not going to get a ticket again.

    only for a few months to see how traffic flows, or so they say, I think its so people get used to no bus lanes then they reintroduce them and heyyyyyy a nice little earner

    Hilarious! PCNs don't go to 'court' as such.

    But as long as you have appealed to TPT and they uphold your appeal you will be fine. Ignoring the penalty if you lose would be madness and would result in court bailiffs.

    I'm so glad you think it's funny, but read the whole post and see how the council act. They cant have it both ways depending whats best for them at the time

    I hate the Councils in terms of PCN enforcement, as much as the next woman - and I post on pepipoo all the time to help people get off them. But it was your insistence that bailiffs couldn't do anything that made me laugh.

    Think about it logically your vehicle is a licensed private hire vehicle, you believe you should be able to swop and change between being a PHV and a private vehicle.
    It's not feasible is it, you can use the vehicle for your own private use but it is still a licensed PHV. If by removing the plate you become a "normal" vehicle imagine what skullduggery you could get up to.
    A PHV has to be prebooked, a private car can pick up their 4 mates late on a Saturday night when they recognize you and wave you down.;)

    Think about the bus lane, it allows you to use the bus lane for the benefit of your customers, to make the journey short as possible. Now the council can't tell if you are nipping into town for your own purpose but because of the plate they will not do you. On the day in question you were not a PHV because your badge was not on display, you can't have it both ways!

    As far as the penalty goes you don't get a claim or a summons you will get a visit from the bailiffs with a warrant.

    As a side issue it is horrible to get into a taxi/PHV when somebody has been smoking in it, my wife actually says no thanks and goes to the next in the rank.

    My understanding is that smoking is illegal in any vehicle other than one which is private or being used exclusively by one person. I don't think that by simply removing the PH plate removes that 'offence'.

    Secondly (as already mentioned), a private hire vehicle is not technically a taxi. Only vehicles licensed as 'Hackney carriages' are and are normally allowed to use bus lanes. However, some LA's allow PH (or mini-cabs) to use bus lanes when carrying a fare ONLY.

    Thirdly, a bus running off service (or being used on private hire) would probably be not entitled to use the bus lane either, but that is irrelevant to the OP as an argument.

    Don't think the OP will win this one IMHO.

    But it doesn't go to court, penalty charge notices never do. And councils most certainly act in that way
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I don't want or need to be able to swop from P/H to private vehicle, one part of the council is saying if the plate is in the boot it's not licenced but another part are saying it doesn't matter where the plate is the vehicle is still licenced. yes a P/H has to be pre booked, but I can still pick up family and friends with my plate and door signs on as long as they do not pay. I am not breaking any laws.
    As for bus lanes and my plate not on display, that was a simple mistake I renewed my plate and got in my car and just went into taxi mode :o and drove out of town.... I don't want it both ways, I just want it clear, if my plate is not on display am I licenced or not.
    The council will not allow any one with out a P/H driver licence to drive my car because it is a licenced vehicle, below is a quote from Liverpool licencing department


    "The vehicle is a licensed vehicle for the life of the licence period regardless of whether you have the plate in the boot and door signs taken off. Any driver of that vehicle is subject to the licensing conditions. You would have to surrender your licence and plate in order for you to smoke in the vehicle or to allow any other person to drive the vehicle.


    As for the bailiffs, I thought as long as the debt is in dispute they cant act.
    As for the P/H stinking of smoke I would complain to the taxi office
