My understanding is the lack of PD is covered by point 2 anyway.

At the risk of stating the obvious - your friend should write a strong letter to the landowner as he/they have the power to get this charge cancelled even at this late stage.
Be aware that once court papers have been issued, PE have history for refusing to cancel the charge unless the defendant pays £50 towards their costs. But they do that in a 'without prejudice' letter which cannot be produced to the court.
If that happens, come back and we'll help you with that.

What happened in the end? I only ask as many will pick up threads to seek advice and find no result....NO to pasty tax We won!!!! Just shows that people power works! Don't be apathetic to your cause!0
