Bailiffs are coming and I don't know why!

    To have a CCJ granted against you the creditor has to prove to the County Court that there is an outstanding debt that you have failed to pay and that they have tried to contact you at all the known addresses that they have for you and that you have failed to respond to (even old addresses).

    By law a letter is deemed to be have been delivered 2 days after his been posted, even if you have not received it.

    You need to check all 3 credit reference agencies as the details held by each MAY be different.
  • Thank you. I have checked trust online and there is nothing coming up for me at all. Sounds like this bailiff may have just bought out some debt recently and is just threatening to get a CCJ to scare me.

    Grrr, I just wish I knew what debt this was so I can see if it was even me.
  • I'd hazard a guess that if nothing's coming up on any of the three reports you've got, then this CCJ's purely fictional, and you can tell the bailiff to take a running jump, in as kind or as brutal a way as you see fit.

    If they don't want to prove a debt (that looks like it doesn't exist) then that's their problem, not yours.
  • Well I've now managed to speak to the county court in the area I used to live, and they told me it isn't their bailiffs. Of course, even if they are court bailiffs, they could be from a different court in the area of the claimant so I suppose that doesn't narrow it down. Still no response from the new tenant who is supposed to be forwarding me the letter they left. I'm worried that time is ticking away.

    It could be a debt collector a lot of firms are bailiffs and debt collectors Marshall Hoare Newlyn, Marstons to name a few are firms of bailiffs and debt collectors so there headed paper my say they are bailiffs but they could be working as a debt collector in this instance

    If there is no CCJ registered against you and they are bailiffs then it could be council tax ,parking ticket ,Magistrates court fine (wont be the first time someone has been fine by TV licencing or the DVLA without them knowing)none of these would show up on the credit reference agencies

    regardless of who they are do not invite them into your home they have no legal right of enter no matter what they may tell you they don't need to phone the office from your phone ,use the loo ect Bailiffs (if they are bailiffs) will be very economical with the information they give you hoping you will simply pay up do not let this happen

    when you phone them please please please record the call

    Just to add Bailiff firms cant buy debts they can only enforce them
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    Yesterday I got a call to say the bailiffs had been round at my old address looking for me 'regarding a CCJ'. I'm not aware of having a CCJ or any debt whatsoever. I checked my credit score online (came out as 999 and nothing on there outstanding or that I didn't recognise) and I searched Trust Online which showed no orders or judgments registered against me.

    I'm currently waiting for more information - the info about the bailiff has come third hand. The new tenant called the letting agent, who called the landlord who just happens to be my mum. The new tenant has agreed to scan the bailiff letter and send it but has forgotten to do so and is now at work.

    Any idea how I can find out what this debt could be? My rent was paid. Council tax was paid by my mother (and she got a refund when new tenants moved in, so we know this was paid). My utilities are all up to date and mostly with the same suppliers now. My credit card is at zero. No car payments, no furniture on finance, no payday loans. No speeding or parking tickets that I know of (and I did update my V5 so my car was listed to my new address). My bank details haven't changed. I'm wracking my brain and can't think of anything it could be, and have no way to get in touch with the bailiffs.

    I am really upset about that because I am one of those super-cautious people who never gets anything on finance. I try so hard to be responsible! I have a very unusual surname, and an odd spelling of my first name, so it doesn't sound likely that they just have me confused with someone with the same name.

    Can I have a CCJ without knowing it? And if so, can I appeal it? We were hoping to buy our own home next year and I will be devastated if this stops me. If it turns out I have overlooked some bill, I will pay it back immediately with any interest, I just don't want this on my record.

    Lastly, is there any way at all I can find out who might be looking for me? On the off-chance that this is just a threat of a CCJ, I want to intervene before it gets this far.

    Has someone from your old address used your details?

    If it is in the old address then they need a warrant for the New Address.
    They also require police to be present if entering on a warrant.
    Contact the court and find out who the creditor is. Find out when and where the credit was obtained. If you know it is not your debt then tell them you are contacting the police to report the fraud and give them the date you left previous address. Also contact company and dispute the debt and if any judgement already entered then go to courts and ask to make an application to set decision aside and get a new hearing date. Complete forms and attend.
  • Thank you, I will do all of those things but as yet I don't even know the issuing court and/or who the debt collecting agency are, since I can't get the new tenant to forward me any of the information.

    I am beginning to be concerned that the new tenants have done something in my name, since they are so reluctant to help.

    What a situation!

    If I were u I would get the letter off the tenants for the details of this alleged debt before go any futher. At the moment you are getting yourself stressed over this issue and in the dark when as you said it is most likely a debt not related to you!!!
    The tenants do sound 'dodgy' - at the moment you have nothing else to go on but what they said- no paperwork / no details. I would try to get your parents to go over in person and get the letter of them and not let them give any excuse.
    In the meantime try not to stress too much (probably easier said than done) - as you said you have no outstanding debts, let alone CCJ- its either a misunderstanding or a fraud.

    Let's look at the facts, at the moment the bailiffs /debt collectors don't even know where you are, so even if it is your debt it's going to take a while to find you.

    It's probably not your debt, it could well be someone else or a similar name, as and when you get the paperwork have a good look at it and then make your decision.

    And don't panic :-)

    Why didn't you ask them what the alleged debt was about when they called you?

    Anyway, if the bailiffs do arrive, the first thing they will do is establish they are speaking with the correct person.
    If so, they will provide you details of the debt, which presumably will be info of the CCJ and the court it was issued from.

    If a CCJ has been issued against you, the bailiffs cannot do anything about that (other than collect the money owed). If you wish to appeal the court judgement, then you will need to contact the court.
