Right. Yesterday I posted a letter to my employer asking for the hearing to be postponed, bearing in mind that
A. It probably wont be phyisically possible to get there in time following my health assesment. (45 mins plus time to go over what her report will say apparently).
B. The report above is to be sent to my employers, not much use if they've already sacked me!
They will have recieved a copy of my appointment details before arranging this hearing, and I'm beginning to wonder if there's a little bit of collusion going on here. almost like they never expected me to attend.
I've also emailed the union to tell them of my change of mind. Looking forward to thier reply!!0 -
For a reason completely different from the issue here, I found myself with union rep discussing my lack of ability in my job, after being managed carefully towards the door. Impossible targets set, targets missed, more targets set, targets missed etc.
Rightly (now I think about it 15 years later), they chose to release me, but the union rep negotiated with them, and they agreed that I could resign. I said that I needed to talk with the Benefits agency, as I had to support a family.
They were pretty fair. They said, yes, I could resign, and in writting explain why it was really a sacking, and they would check my story with my ex-employer, who would explain to them that had I not resigned, I would have been sacked. And they (the lady at the benefit helpline) would prefer that as I'd be more likely to get a job if I'd been seen to resign.
In the OP's case it's very different. A serious unproven allegation has been made, he's broken "safety" rules which everyone else might have breaking. In which case custom and practise comes into this. I think the whole school culture needs to be brought into the open, and the local union rep, replaced with one from HQ.
On a slightly related point, a mate of mine was working as a quality manager for a big firm, when 12 of the quality staff were suspended over internet misuse (They were emailing each other rude and offensive jokes).
The union stepped in a negotiated that since once the quality staff had been targetted, and no other staff, and there was evidence that it was custom and practise across the company, that unless all staff were investigated then it wouldn't be fair to sack them.
The result was clearer guidelines and a much more rigourous policing and 12 people got a second chance.0 -

OK then, here's the update, at last!!
I couldn't get them to postpone the disciplinary any more (the doc said it wasn't feasible nad I'm not one for swinging the lead, so that's OK). Anyway, I went along to the disciplinary hearing, much to the annoyance of my union rep, said my piece , and was dismissed as expected. And you know what, I feel like a huge weight has been lifted from my shoulders. It's not nice being sacked obviously, but seeing the two governors (who i have known far ages) squirm with embarrasment was funny, as was the face on my union rep as I laid into to everyone. I let it be known that ,yes, the rules had been broken, but we all did, and i had evidence against me, simple. etc. etc.
Apparently when the staff were told it took an hour to calm them down, and mangement are not having a great time. i've had a lot of support, texts, messages etc.....makes me feel so much better.
Two further things. There has been no contact from my union rep, not a squeak, since this. No advice on what to do next etc. even though I dont need it. He's in for a shock when my complaint goes to his boss about his attitude etc.
Secondly, and more relavent. As a matter of course, the school have reported me to the DRB as its now known, apparently because i resigned during and investigation, but the policy says they would have done it anyway. I've got a letter saying it's now being investigated and id know in due course. I telephoned them and spoke to a really nice lady who told me not to worry, as I would have ample chance to have my say on everything about this, and they were not in the habit of looking for guilt, rather the other way. It will take months, and they've said just carry on as normal until they say. So, it looks like the failings of the schol will be heard anyway...i cant wait! onwards and upwards.0 -
I am glad you did what was right for you. You may not have your job, but you have retained your self respect, putting aside the materialism of this world, who we are as a person is what we take with us when we depart. As you say onwards and upwards, stay true to yourself and you will be alright.
