CMS Limited Parking Fine In Hire Car

Hi all, need some advice please...

My car got written off last week, so I travelled up Leicester to buy a new one in the hire car the insurance company provided.

The guy lived in some flats, little did I know I was parking on a private car park where you needed a permit. The guy didn't tell me (idiot) and after buying the car from him and returning to the hire car I had a £60.00 fine from CMS Limited!

I've seen other threads on here saying they are a scam and just to ignore. But Enterprize took my card details incase of any parking fines or speeding tickets so as soon as they hear about this they are just going to pay up! Plus it rises to £100.00 after 14 days.

What do I do? Surely, Enterprize aren't going to be interested and will just pay up without dispute.

    They won't get the chance to pay it nor even know about it, because you will be appealing it and beating it at POPLA. Read a few current threads (where on earth have you found old threads saying to ignore, we haven't given that advice since the Spring?!). Read about POPLA, you must read current threads on the first few pages now.

    But won't they check the registration and send the bill to Enterprize who in turn will just pay using my card details? Shall I mention it to Enterprize?

    How long does the POPLA process take and is it difficult?

    No, no, and no. It's easy as long as you act now.

    And it's not a 'bill'! It's a scam, a spurious charge you can beat at POPLA.

    But you must send an appeal now as the driver (not mentioning that this was a hire car, in the appeal).

    POPLA is one letter or email and it's a matter of copying examples we show you. EASY. Then POPLA take a month or two to find in your favour. Read the most recent POPLA decisions in the POPLA decisions sticky thread at the top (read the latest posts first on that long thread), I have just updated it today with three POPLA cases won!


    I know nothing about your case and yet I can write you a first appeal because it's pretty generic and NOT about what happened. I have called you 'the keeper' (which you were that day) and written it as 'we' (please do NOT change it to I even if there was only one occupant of the car):


    Dear Sirs

    PCN Number xxxxx
    Vehicle Reg Number xxxx

    As the keeper of the above vehicle, as defined in the Protection of Freedoms Act 2012, I wish to appeal against the parking charge on the following grounds:

    1. The Notice to Driver is invalid as it does not comply with PoFA 2012 in various ways which I will elaborate at POPLA stage.

    2. The sum claimed is not a 'genuine pre-estimate of loss' in any way, shape, or form.

    3. There were no signs with parking terms at the entrance to the car park, and we saw no prominent signs to communicate any need for a permit.

    4. You don't own the land and so I will require sight of your authority from the landowner, in the form of your contract, which I suspect is also not BPA compliant.

    5. We were visiting a resident and had their permission to park.

    In the circumstances I expect you to cancel this charge. If you refuse to do so, then you must send me a verification code in order for me to appeal to POPLA.

    So I am sending this to CMS Limited to begin with, basically just send this word for word? And is this through their website?

    PCN number is the 'notice reference' code?

    So I put my full name and postcode at the end, what about a house number? Does this mean they won't contact Enterprize?

    Are you the registered owners of the vehicle (tick yes)

    Were you the driver of the vehicle (tick yes)

    What should I put?

    Try sending it without ticking them, if that fails send it via snail mail with proof of postage from the post office. Don't admit anything like that and you should send it via mail in any case
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Although on there they do have a BPA badge, is this bad? As I've said about them not being :/

    Seems fine as long as they got an address, they should now reply within 35 days and if you get a POPLA code come back and tell us. If you don't get a POPLA code come back and tell us!
