Refused a return

Options
Hi

I ordered a pine single bed from an internet company. However it is not suitable for the slats I have and I want to return it but the company say that because it is out of the 7 days they stipulate (it is not clear, they only say that returns are guaranteed within 7 days) Don't you have 14 days? Also they said that because I opened the package to examine it they would charge me £20 for new packaging plus £60 postage..

I ordered on Oct 1st and it came a few days later. I delayed due to waiting for the different slats I ordered from somewhere else to arrive.

The packaging charge, yes, but the return delivery charge could be legitimate.

Just to clarify - the 7 days is over so that will not accept a return.

    Please be more precise.

If it arrived on Friday 4th October, then you can still cancel the order under Distance Selling Regulations, but you must do it today... in writing. Email is ok.

DSRs allow you up to seven working days, starting the day after delivery, in which to cancel your order and receive a full refund of all monies paid.
You probably will have to pay the carriage costs to return the thing though.

If it arrived after 4 Oct, of course you have more time in which to cancel.

It does not matter that you have damaged the packaging, although you will have to repack it securely to return.

How long is a few days later? What was the exact date? You get 7 working days to inform them of your intention to cancel. If it arrived on the 4th then today is your final day, if it arrived sooner then you are outside the timeframe. If it arrived later you are still in time to cancel.

If you are outside the timeframe then the bit they told you about charges is not tosh at all, it is them allowing returns outside your legal entitlement and they can add whatever terms to the returns policy they want as long as they are the set terms and not just added now you want to cancel.

I got the email from them on 1st Oct saying it would be here in up to 5 days and I am not sure exactly when it arrived as I have been so busy with other things. It might have arrived the next day making it the 2nd. I informed them on 13th that I want to return it and spoke to them today as they had not answered the email.

As I said above, you need to be more precise.

Pretty sure the delivery people will be able to say when they delivered it, so maybe not a good idea to make up an answer that fits... but I am sure you wouldn't do that anyway. :D

As I said the earliest would be the 2nd. I dimly recall that it came quickly but it could have been a day or two later than the 2nd. One of the problems has been that the supplier of the alternative slats said last Friday the 11th that he would speak to the manufacturers to ask if there could be an adjustment made to enable the new slats to fit..

I did lose track of things a bit as in between I had to travel to (5 hours) and stay overnight at a hospital I attend.
