    Have you talked to them about money laundering charges? Works miracles when they think their bank account will be frozen for 6-12 months whilst the understaffed and overworked officals investogate.
  • I've just rang my bank and filed for a DD reversal. I'll find out tomorrow whether it's been approved or not.

    That's promising. I believe under the DD guarantee you are entitled to an immediate refund if there has been any error on either the bank's or the company's (HA) part. I know technically at the time it was paid, it wasn't an error as you were still living there so there may be a bit of a kerfuffle because of that. Fingers crossed that's not the case!!

    Lady in the CS at the bank said she's sent a request off to their back office team and it's up to them, and the rules of the DD agreement, whether I get it back or not. Seems like they don't have to ask the HA in order to return it.

    Knowing my luck there's probably a 90 day limit or something on these kind of claims which I'm just past!

    Either way I'll post the outcome here tomorrow.

    That's an interesting point. I will have to recheck the texts she sent me bragging about the refund but I'm sure she reckoned she got in the region of £500, whereas the amount I believe I'm entitled to would've been slightly short of £400. Would make sense as the amount she mentioned certainly seemed a bit odd at the time.

    If this is the case and the money she's pocketed came from HB and the amount I'm chasing has gone towards her future rent, would there still be a chance I could claim it back?

    She doesn't sound like the brightest spark in the box so she may not have known exactly how much it was or she may have received other benefits at the same time as the HB. She also might have exaggerated to try and rub salt in the wounds. I wouldn't trust anything she says because you can't verify it and she clearly can't be trusted.

    I think you'd have a stronger case if she has received Housing Benefit to cover that period of rent but still kept your money because it would be clear in court that she made alternative plans to fund her rent for that month but failed to give your money back. I'm not a lawyer though so I can't be sure.

    Good luck with your DD guarantee, if it doesn't work I would see the CAB about going to the small claims court. You might have to wait for an appointment for a while/book one a while in advance.

    Good news. Just spoke to the bank and they said the full amount will be returned to my account tomorrow.

    Girl who sits by me in work reckons I might be asked to pay back the couple of days I stayed there at the start of July but if I wasn't on the tenancy then I don't see how I'm liable?

    She was willing to keep my money and also told me to get lost when it came to paying a £154 bill her daughter had rung up in just four days on my phone (which she previously promised to help me with) so if she comes asking she can get stuffed for a change!

  • Refund has just hit my bank!!!

    I'm already gettting £250 off Santander towards the conveyancing costs on my new flat. This should cover the majority of the remaining balance.

    Thanks for all the help again everyone. Don't know why I didn't think of doing this sooner.

    I'm also interested to know if you plan on informing your ex of your little windfall!? Or will you just leave it and see if she contacts you? I think after the way she has been with you, I would be inclined to let her know. Only for the sake of politeness of course...:D
  • Tempting, but I think I'm going to play the cold silent assasin on this one. It'll be a nice little surprise for her when the HA come demanding the money back again. She'll innevitably kick off at me and want to know what's gone on but I'm affraid I won't be able to discuss the matter due to "data protection" issues! ;):D :beer:
