Hello. wondered if someone can shed light on this..
Had the most miserable client since I started bussines 7 years ago..ajob via insurance claim for water damage
First day--woman tries to get a new fridge from me..
second day-woman complains her camera has disappeared,,then finds it when I tell she should call the police and we are happy to be answering the police
day 3- making my painter sick,,tellinghim how and what roller to use etc
anyway we finshed the job..sent invoice ...she s come up some stupid stuff she s not happy....I have kept asking to go and have a look, she s just sent me pics and wont let me see the problem.
have asked for me and her to get a quality surveyor but she doesn't want to so finally I went and filled a small claims court online .When I did, I was meant to put my company name on it but had no options so put my name ,paid the fee and the woman has rejected it , in fairness to her saying she s got no contract with me personally ... Can I get that fee back?
went online today but cant find how to register as a company not as an individual...

Are you a sole trader? If so your name on the claim should be fine.
When you say she has rejected the claim, is this something she has told you or has she sent a formal reply to the court?
I would phone the court and ask for their advice. They cannot discuss the merits of your case, but are very helpful on the procedures involved and giving advice on how to complete forms.0 -
Who is your contract for the work with?
- the householder?
- the insurance company?0 -
What sort of client makes a complaint and then refuses to let you actually inspect the work with both of you present? It's absurd.
This makes no sense: if it'a an insurance repair, then your contract is with the insurers who commissioned you-not with her?You are just a sub-contractor.No free lunch, and no free laptop

Contract was made as my company to the client , not to the insurer so cant blame the insurer
the woman is as I said the maddest I have ever came across to work for ..wouldn't leave house unless we left,..still tried to blame us for stealing her camera.0 -
When claiming as a company, just put the company name in where you would put your name.
If you are a sole trader, then you need to put in as 'Joe Bloggs T/A company name'.Never Knowingly Understood.

Hi Pat, it s got 3 tabs one for first log in, one for individuals and the last one for organisations etc which is mainly for layers if they need to represent a client if you fill the individual ones, you can t change then but anyway will call the helpline tomorrow again.. today 25 mins , couldn't get through0

You can file to change/correct the name , it's not a problems .you will need to keep on top of the case and chase the court up at every stageVuja De - the feeling you'll be here later0

If this was work given to you by the insurance company, shouldn't it be the insurance company that should be paying you?
But they won't pay you until you invoice them direct.
Anyway, regarding filing a claim online via mcol, you need to register either as an individual (i.e. you) or as an organisation (which can be a solicitor, a limited company, etc)0 -

If you do not understand the importance of answering the question on "what type of company" are you, sole trader, ltd etc., then I am afraid you are wasting yours and everyone else's time asking for help.
