I bought one of those cheap £300 crown lcd tv's from argos, it was delivered on the 29th march, i was happy with it until it went wrong tonight, the screen went all sketchy with flashing red lights all over it, i phoned customer services and was told to phone the tech help line, but they were sht, the customer services told me that i was not entitled to a refund as it was past their 30 returns policy, i have to accept a repair, i told em no, i am not having a repair to it as it was not even 3 month old, they insist i am not entitled to a refund....are they correct, or can i insist on a refund after the argos tech guys have looked at it, as the fault must be inherrent.
sorry if i am on the wrong board for this thread

I am not a lawyer, the below is my interpretation of the consumer laws
If you bought this new, then you should expect a full refund - assuming that the fault is solely down to the television. UK consumer law states that goods should last for a reasonable length of time. Televisions failing in 3 months is, to me, not a reasonable length of time.
From what I've heard and read, many companies try to get you to accept a repair as this may alter your rights regarding a refund. You should demand a full refund of the original purchase price and also that they come and pick up the broken television.
To be as sure as possible, I'd give Trading Standards a phone (try the saynoto0870 site) and explain what's happened as thoroughly as possible and then take their advice.0 -

A repair I would say, you don't buy say a new car and when it goes wrong, they replace it with a new one.
If they cannot repair it, then you will get a refund.
Yes, posted in wrong section.;)0 -
AFAIK it dosn't matter what the shop tells you about their 30 day policy or whatever (unless it's more generous than the law!) For the 1st 6 months after purchase you have extra rights & its assumed that the product is faulty. I'm not sure about your repair/replace rights though.0

Before 6 months it is the responsibility of Argos to prove you have broken the TV.
Your contract is with Argos (even after 6 months) and not any manufacturer despite how many times they say its gone 28 days.
See: http://www.dti.gov.uk/consumers/fact-sheets/page38311.htmlWherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale). If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)If a consumer chooses to request a repair or replacement, then for the first six months after purchase it will be for the retailer to prove the goods did conform to contract (e.g. were not inherently faulty)0 -
