Easy finance club/NDR/ Marshall hoare

Hey! My first post here so yeah...

It might be a wrong section for it, and if it is then feel free to move it :D

So my first problem started when I took payday loans to cover expenses and etc... Later on I was taking payday loans to pay back other payday loans and so I decided to stop and cause damage to myself and other companies. So I went to PayPlan that did a great job with DMP and all creditors accepted "affordable repayments" except Easy Finance Club that declined. I have received some e-mails, but not correspondences (letters) at all :eek:. Interesting thing is that after when I started DMP I was alrey with NDR that quickly after hearing from PayPlan transported the case to Marshall Hoare. This is an email that I have received:

Consequences of inaction:
1. Court Action legal action may be started in the County Court (or Sheriff Court if you are in Scotland) for recovery of the full amount outstanding. Any such proceedings will include additional claims for legal costs and interest which will increase the amount you will be requi red to pay.

Interesting thing is that I borrowed £400 and I was supposed to pay back £528, which after 2 months it became as £1174!!!

Before it went to that disgusting amount of money it was:

1. £528
2. £639
3. £900
4. £1189 - 14.51 (DMP) = £1174.49

These are charges in the agreement:

9. CHARGES

9.1 The following charges are payable under this Agreement:
9.1.1 transmission fee (GBP5);
9.1.2 account maintenance fee (GBP0); and
9.1.3 using an alternative method of payment (either credit card, bank transfer or

direct debit) (GBP0).
9.2 If you fail to make payment under this Agreement, you may be charged the

following additional fees incurred in recovering your debt:
9.2.1 where we have to apply for a County Court Judgment or Warrant of Execution

(GBP45);
9.2.2 where we have to engage with Solicitors or instruct other legal services

(GBP150);
9.2.3 where we have to engage wi th Debt Recovery Agents or other agencies (GBP200).
9.2.4 where, after the first 28 days you miss each scheduled payment

(GBP10)
9.3 We may vary the charges set out in this Clause 9 by giving you reasonable

notice in writing, unless the change is to your advantage in which case we may make

the change immediately and will notify you of it within 30 days.

10. INTEREST FOR LATE PAYMENT

10.1 If we do not receive the appropriate payment from you in accordance with

Clauses 7 and 8:
10.1.1 we will continue to charge interest on the Loan Amount. The rate of interest

will be the same as set out in Clause 4;
10.1.2 interest after default is charged at the end of each 7 day period, starting

with the day after payment is due. The rate of interest may be charged before as well

as after any court judgment;
10.1.3 we may require you to pay interest accrued at the end of each 7 day period,

starting with the day after payment is due, in which case we will give you reasonable

notice of such requirement; and
10.1.4 we may continue to attempt to collect payment of the Loan Amount and all

accrued interest (or any part thereof) from you as set out in Clause 7.2
10.2 We may charge you a fee of GBP 32 for late payment. We

may also charge you for any costs and expenses (including enquiry agents, debt

collections agents and legal costs) reasonably incurred by us in enforcing this

Agreement.
10.3 We may vary the late payment charge specified in Clauses 10.1 and 10.2. We

will give you reasonable notice in writing of any such variation, unless the change

is to your advantage in which case we may make the change immediately and will notify

you of it within 30 days.


Thing is that on DMP (£50 that is shared amongst others) they get the most most money (£13.50). I don't understand why other creditors agreed where NDR/Marshall did not straight away. When I called them they said to me that the minimum they will accept is £50...

What should I do? I am so sorry for that long post, but spoilers do not work as intended on this website. Plus their websites does not work O.o

    Marshal Hoares are just EFB/toothfairy/webloans (or whatever other daft name they think up) pretending to be bailiffs.

    Pay them whatever you can afford under your DMP and report them to the FOS and OFT for their bully boy tactics.

    These clowns cannot make you pay over £1k when you only borrowed £400 two months ago so don't panic. Plus they NEVER take people to court. A judge would rip them a new one for their behaviour.

    There's no point in trying to discuss your debt with them at all, because they'll just keep trying to bully you and basically ignore everything you say.

    They do have a bailiff working for them, which is how they get around using the word 'bailiffs' in their company name I think.

    I have never read any reports of them actually carrying out genuine bailiff work though, just bullyboy debt collection.
