Have I made a faux pas?

Someone has scraped their car along the back end of my car:mad:
She admitted fault ( I was parked at the time) and we exchanged details except for her insurance ref number ( details at home)
I told her I would phone her for this detail but no luck yet.
Now I have gotten over the shock I am wondering if I did enough in case she now denies fault?
Should I have got her admission in writing? Are the photo,s I took of the damage ( both cars) be proof enough?
Maybe I am panicking too soon.
Any advice gratefully received.

Write down all the details then call your insurance company.

If you have the name, address and registration of the other person then they will be able to trace them anyway.

You certainly don't need the other drivers insurance ref. number. To be honest I don't carry a note of my own policy number with me and so wouldn't be able to hand this over. Driver name, car registration number and insurance company are sufficient. That's all I provided when another car hit mine a year ago and there were no problems.

I think you'd be hard pushed to get anyone to sign liability for an accident at the scene, so don't worry you didn't think to ask for that!

(Oh, and certainly a not a faux pas:

  • You have pics of the 2 cars with what I assume is corresponding/ consistent damage. So this would make it difficult for the other party to deny involvement, they may try to deny liability but that's another story.

I would give it another 24 hours and then leave a message/ send a text advising you will be involving a claims management company who will just seek out details of their insurer by checking on the motor insurers database and going direct to their insurer - so they won't be able to keep it off the radar.

They also have a legal obligation to provide insurance details under section 154 of the road traffic act http://www.legislation.gov.uk/ukpga/1988/52/section/154

Finally - if you go to https://www.askmid.com and put their reg number in, it will at least tell you if there is a record of insurance held for that car. If there is no record of insurance, I would make a report to plod straight away.

Why? The OP has presumably told their insurer, and if not, they should immediately. The insurance company will then deal with this. There is no need to contact the other party.

Edit: I took the OP to mean that the insurance company was known but not the reference number. If the company is unknown then trying to contact the other driver would be useful.

Thank you all for your positive suggestions.
I informed my insurers so will let them deal with it.
I was getting in a flap because many years ago something similar happened and my then insurers told me that if the other party denied fault then it would be one's word against the other!
Thank goodness for camera phones these days!

If you were parked i doubt it was required for her to admit anything. Also her admitting liability is not good for insurance.

I'm afraid no one can promise that won't happen again now :(. Hopefully you'll be OK though.

I was in a similar position 3 year ago - a woman hit me from the rear at a roundabout - she left me her address - I informed my insurers who told me that I would lose my OWN NCD and would have to go through the hassle of reclaiming my own loses via this womans insurance ...
I eventually decided not to pursue it..
