car towed from wembley on event day

hi all

basically, my car was towed from wembley this morning as its an event day with the england game on tonight

the facts are as follows, i parked on a single yellow in a buslane (on normal days you can park between 10 and 4pm, basically the bus lane is only in operation between standard times of 7-10 and 4-7)

as today was n event day the parking restriction said "on event days no parking 7am til midnight", i parked at 1005, came back at midday and my car was gone at which point i realised it was an event day

called up the impound who said the car had been towed so i asked when the pcn was issued, the operator said because it was contravention 02 a pcn did not need to be issued for the car to be towed

so i asked what the cost was and he said 265 (200 for the impound fee and 65 for the ticket - which he told me minutes before need not be issued)

anyway, he then said the ticket was issued at 1102 and the car towed at 1107

so my understanding is i have to pay to get the car back, which i will do when i can get a lift later today, but with those basic facts is there any assistance to help me out, first offence of this kind

also, there is no sign nearby indicating that today was an event day

cheers guys

Anyone parking illegally within the event day zone will get a parking ticket and may have their vehicle removed.

  • if they issue a parking ticket, do they then have to allow 30 mins for me to remove my car before towing?

also, while the sign may say what the event day restrictions are, do they also need a sign indicating that today is an event day?
  • the description of the contravention says this:

Parking or loading/unloading on double or single yellow lines when a loading ban indicated by kerb markings is also in force.

what do they mean kerb markings?

Right so the first thing to understand about a Council tow is that MOST people can get a full refund (in some ways it's easier than appealing a PCN!). Trouble is you have to pay up front to get your car back - if you haven't done that yet, then do not prompt them at the pound for any appeal documents - just silently take whatever forms they do give you.

Contravention should be 01 if it was a normal double yellow, IMHO. Also an immediate tow when the event isn't till the evening seems disproportionate, when a person could have been loading/unloading (unless you have somehow missed the kerb blips and loading restriction).

You have 28 days to appeal and it's then a complete no-brainer - OF COURSE it's worth appealing any Council tow to the adjudicator (mad if anyone doesn't seeing as it costs you nothing, it's a risk-free appeals procedure, and Councils muck up the process soooo often!).

So once you have your documents (PCN, appeal sheets, authority to tow sheet) from the pound, take a scan or pic of all of them and post them in a new topic on pepipoo forum to try to get advice to help you get your full refund (tow fee, PCN and all):

    http://forums.pepipoo.com/index.php?showforum=30

Also include in your first post a GSView of that bus lane, using the chain link icon on GSView to generate the URL when you are looking at the very place online. Do not post without pics of every page of all documents or your thread will be overlooked in favour of those who have included the documents.

Oh, and as soon as you click on that pepipoo link put the keyword 'no-brainer' into the search box bottom left. You will see loads and loads of successfully appealed tow threads, to learn from them as to what to put in your appeals. It's only 2 stages (Council, then adjudication) and risk-free in these circumstances - hence why you can find Council tow threads on pepipoo by using that peculiar keyword!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

Is this the exact wording? There is no contravention with this wording.

An 02 should be 'Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force'
  • very thorough thanks coupon

and oxford, the wording of the title is as you have written it, its the description later which is what i wrote
