Hi All
I received a number of letters from Parking Eye alleging I had overstayed at a motorway services (by 20 minutes) - I have not responded to any of their letters. Today I received one entitled "Letter before County Court Claim" - is this to be treated the same as the rest or do I need to act?

Please don't ignore this, it's the first step to a small claim. Have read of this thread , it tells you how to respond to this. Please come back here once you have a draft letter

No one has been advising 'not responding' (aka 'ignoring') for the past 6+ months, and so this latest bit of correspondence is definitely NOT 'to be treated as the same as the rest'. You definitely do need to act, and here's how to start things off:

Never ceases to amaze me how many people ignore these in 2013 when the advice is NOT to ignore and we type this every day! You could have beaten this on appeal and are now close to being taken to court. See Umkomaas' link now.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you - I am reading the threads now. There is quite a lot to read and yes, its obvious now that ignoring is now not good.
I am looking to draft a letter - would it be ok to post up a suitably anonymity image of the para written to me in the LBCCC? This in order to which bits of the PD are they non-compliant on?

Thanks you - unfortunately I was not looking then, only searched now. When this happened a few years ago - I did ignore and it stopped. Its easier to be wise after the event of course! I am reading now.

For more focussed advice about PE, including a look at one of their LBCCCs and advice on how to respond. Their LBCCCs have gone through various transformations but the content doesn't alter much (remember to read the back of the LBCCC too).
I haven't updated the guidance for PE yet, but I suggest that you include a final paragraph along the following lines:
'Please do me the courtesy of reading and replying to this letter. Please note, if you send me a generic template letter which does not address my requests for information, I shall copy the correspondence to the Solicitors Regulation Authority and ask it to investigate your breach of the Principles set out in the SRA Handbook version 8, published on 1st October 2013'.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

If you go to post 3 you will find an alternative letter to send as a first shot, if you are feeling robust. If you decide to follow that route, come back here before responding to any reply you get. But don't delete the acknowledgment that you are currently preparing, as you will still need it.
On the other hand you can simply go ahead and send them a well drafted Acknowledgment - both approaches are perfectly valid.
