Warrant of Execution received for non payment of Parking Eye Ticket

I am writing on behalf of my 73 year old mother who back in May when she was staying with me, parked in a private car park in Cornwall run by Parking Eye.

She admits that she didn't pay for a ticket as she was just picking up my daughter from the beach. Since then she has received a number of letters getting increasingly more aggressive. To make things worse she has been away in Australia for three months visiting my brother and has now returned home to find that she has had a "Calling Card" from HM Courts and Tribunals Service - with a Warrant of Execution - Annex D V1.0, and has been issued a Warrant for the value of £375. This has come from Gloucester & Cheltenham County Court which is the closest court to where she lives!

I feel terrible because I told her to ignore all the letters and that Parking Eye wouldn't take it to court, but this document seems to be kosher and I really don't know where to go from here.

She is panicking and has phoned the court and they're saying she can pay in instalments, but I can't believe how this amount can be fair or just.

Could anyone give me some practical advice of where to go from here. My mum is really stressed by this, and I want to help figure it out. She doesn't have much money and I will have to pay this if we really have to do that. Now it is in the hands of the court, are we able to offer a nominal charge - i.e. the amount of the ticket for the damages they incurred. Or is it too late.

I really don't want people turning up on her door, as I know she will be intimidated into paying this charge.

Please, please can someone give me some advice.

  • Did she receive court papers in the first place?

    She can apply to have it set aside, but will have to act quick to remove any issue with the bailiffs

    Keep windows shut and locked, and don't let them in

    There is a very good site on bailiff advice but as per usual i cant recall the name of it, they will tell what to do in the first instance apart from setting the claim aside (if you didnt receive court papers)

    bailiffadviceonline.co.uk is what is being referred to, they cost a tenner but can offer valuable advice over the phone. You need to act otherwise they could be clamping her car or towing it, so keep the vehicle out of sight locked in garage if possible.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    If the claim is set aside what happens to the money they are claiming.

    Did you not receive a Judgement from the court?

  • I don't think she would even know if she'd received court papers - should she have received those before she had this "Calling Card"?

    the lady who owns the site mentioned in post 6 post on this forum but I would think she will need more info ask you mum what if any paperwork she has received
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites
