spent or unspent convictions??

Hello there.

Son going back in army and has to complete a criminal check form but stuck on one question, and after reading the info in the pack we are still a little baffled to the answer.

Basically the question relates to spent and unspent convictions.

My son has had a little brush with the law back in 2010 while serving in the army but off duty as such.

The offence was he damaged a car in a scuffle with some other people on a night out. Nothing more. He was taken to a civilian court and fined and I think the term was called 'crminal damage' He was fined and that was that, he was also fined in the army court too. He paid the civilian court in one go as it was only a hundred quid.

He was not bound over or anything else.

My question is: Is this a spent or unspent offence??
All the big powers they've silenced me. So much for free speech and choice on this fundamental human right, and outing the liars.

    Unspent unless he was under 18, then I am not sure. The period for most offences is 6 years.

    The rehabilitation period is NEVER 6 years! :D

    It varies depending on the sentence imposed. The precise periods are here

    OP if your son was under 18 when the fine was imposed, it is spent, if he was over 18, then unspent

  • This will help:

    Conviction type
    Rehabilitation period
    (After which conviction is spent)*
    Non-custodial sentences
    (community service, curfew orders, fines, probation etc)
    5 Years
    Prison sentences up to 6 months
    (including suspended sentences)
    7 Years
    Prison sentences of between 6 months and 2.5 years
    10 years
    Prison sentences over 2.5 years
    Will never be spent

    *Depending if the conviction is accrued before or after the individuals 18thbirthday.
