Faulty TV just under 12 months old. Who is responsible

Hi everyone

I am looking for a bit of advice. I purchased a tv from Tesco Direct at the end of October 2012. It has been constant trouble.

More recently the volume kept dropping and as It is still under guarantee I have sent it back to the manufacturer for a repair. It came back last weekend, with a new main board fitted and tested. However, when I plugged ii in nothing, no picture and no sound.

I sent it back to the manufacturer who returned it Monday and I have today noticed that it still has the sound problem. Every so often the sound dips and then goes back to normal.

Can anyone give me any advice as to whether I can ask for a refund from Tesco's under the Sale of Goods Act or ask the manufacturer for a new replacement.

There is still a bit of guarantee left until the end of this month but it is clear that the fault has not been fixed and I do not want to be left with a faulty tv at the end of this month.

Any help will be greatly appreciated.

    every time its sent for repair your warranty is returned to 12 months, so you wont be stuck with it.
    however contact Tesco and see what they say, usually they want you happy so may offer you a compromise.

    Thanks for that. I did not know that the guarantee would go back to 12 months from the repair.

    I did go into the local Tesco store when I first had a problem with the built in dvd player. They told me they could not help as it was bought from Tesco direct and as I had had it over 28 days I had to send it to the manufacturer. I have since learnt that they were responsible for the first 6 months under the Sale of Goods Act, so they fobbed me off.

    Are Tesco's still responsible as the seller as I am prepared to go and stick to my guns to get a refund or replacement.

    That's incorrect I'm afraid. The warranty runs from the original date of purchase unless otherwise specified in the warranty T&Cs.

    OP, you may need to get an independent report showing the fault is inherent (if it is of course) and then send that to Tesco Direct. If they do decide to refund you though they are entitled to deduct some from the price you paid depending on the expected life of the item.

    are you sure you purchased this from Tesco Direct or was it from one of their sellers from their seller marketplace (http://www.tesco.com/direct/seller-directory/)

    yes sorry only the parts that have been repaired should be recovered by a 12 months warranty.

    however, even though a warranty is 12 months parts and labour, its only the labour that runs out after 12 months, parts a warrantied for 5 years. so when you have a item repaired at your cost you can send the parts back to mfr with copy of repair invoice and the parts will be reimbursed.

    not sure where you stand there daisymeg, but keep on at them and stand your ground. your tv is faulty and you didn't set out to buy a faulty tv.

    Really? Some manufacturers offer a 5 year warranty on parts, but they are in the minority.

    A warranty from the manufacturer can state whatever it wants as this is in addition to your statutory rights under SoGA which are with the retailer.

    As in the case of Apple products

    A replacement part or product or a repaired Apple Product assumes the remaining warranty of the original Apple Product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you.


    or Toshiba

    Replacement parts or products are warranted to be free from defects in materials and workmanship for thirty (30) days or for the remainder of the Limited Warranty Period, whichever is longer.
