    Yes I am agreeing with you Rob BUT I am not sure how you get a good buyer when the two sellers are refusing to agree with each other. I cannot see that your correct observation that in the current market the valuation of the property has probably gone up since the death and another rigorous valuation should be obtained, is going to help free up the log jamb.
    I think a priest or a psychologist or perhaps an arbitrator rather than a confrontational lawyer is needed, I could divorce my wife but I am stuck with my sister ! (fortunately, we usually manage to agree without either of us being too bloody minded).

    I once found myself in a property purchase chain and then discovered the deal further up the chain depended on the outcome of a divorcing couple, so I walked away. The joy of buying from an executor (or a trustee in bankruptcy, I have done both) is that they are chain free and often desperate for a quick reliable sale, the down sides are that estate agents will put anything on the market even properties where the sellers have yet to be granted probate and (I think this still applies) is that they can sell on slacker terms (ie they can reply more realistically "rely on your own inspection" or similar, without risking legal action, to many of those back side covering questions that conveyancers ask.

    Bring back the HIP ?
