PPI Rejected by FOS as over time limit

    Actually, you do have one final chance with the Lloyds ones....they were fined this year for their mishandling of PPI complaints, so you could re-submit the complaints, saying you don't think they were given proper consideration and in light of the fact they were fined, would like them re-investigated.

    Does your brother have all the relevant paperwork of the 4 loans if so don't let these banks fob u off did your brother have a one to one with the banks advisors or was by phone or internet

    It is the Ombudsman who has told the Op that the complaint is out-of-time. The Banks rejected the complaints more than a year ago and the op's brother failed to refer them to FOS. In addition, it's not clear that there is a valid mis-selling reason, given that the OP simply assumed that self employed people were automatically mis-sold.

    It's all rather too late..

    Whether they are "fobbing him off" as you put it or not, it isn't really up to him. The complaint is out of time for FOS. Hence if they stick to their guns there's not much he can do about it unless he can persuade FOS to rethink. Which is unlikely for reasons already explained.

    adjudicators wouldnt make that decision, it wouldnt get as far as an adjudicator, complaints are taking 1-2 years to get to an adjudicator.
    its nothing to do with the ombudsman either to make a final decision, you've misunderstood.

    I have seen adjudicators and ombudsmen make decisions on jurisdiction before now but normally it is pretty clear, as it seems in this case, that the outcome will be to dismiss the complaint without considering its merits.

    Such decisions are usually fairly quick but then if the decision is that they do have jurisdiction it goes back to an adjudicator.

    As I say, though, I think that is most unlikely in this case.

    Adjudicators would issue this decision. There will be adjudicators working on different areas - those looking at whether a complaint can actually be looked into (jurisdiction) and those actually looking into the merits of a case.

    As with any view that comes from an adjudicator, the consumer of business has a right to ask an ombudsman to make a final decision.

    Just an update.....I have been away on holiday. The mis selling was not only based on the fact that he was self employed, he had another policy in force and also was not aware what this PPI was for it was simply added to his Credit Card/Loan.

    The reason he is outwith the 6 months time scale to refer it to the FOS was that he was working overseas (In Africa) The standard rejection letter (from each company) came in the same format, so I presume this is a standard letter adopted by each company to his address but he was not their. I was hoping that perhaps someone had experienced this, but Thank you to all for your comments.

    They are 3 Credit Cards and one loan, we have statements showing the PPI charges, he was unaware what the PPI was until it became public, at the time he cancelled it and was told by phone to wait until the outcome of the court cases.
