Hi All
My ex has an overseas bank account which she has not declared in divorce proceedings.
What can be done about this? Can the UK court freeze the account or are the funds now gone ?
Thanks

What stage in the process are you at?
How do you know about this, and can you prove it?Signature removed for peace of mind0 -
Just at the beginning really. All assets have been declared.
I know because it was an account she had when we worked overseas and a sum was left in there. How is it proved? I don't have the account number or anything but I know the bank and her name and address obviously.0 -
then you speak to your solicitor and say that you believe there is an account in ... dating back to whenever you left that country.
Your solicitor passes this info on to her solicitor. She might go "oh sorry, forgot about that, never use it and there's only pennies left in there", or she might deny its existence. That's when you have to produce more evidence ...Signature removed for peace of mind0 -
You might need to apply to the concerned overseas authorities for disclosure if she is not willing to provide the information. I wouldn't bother if it's not a substantial sum as the application process might cost a few bob as overseas solicitors would be involved too.0

this is perjury , all assets have to be declared , my friend has just had this happen to him when his wife failed to declare an account with 20k stashed in it , a bit stupid of her really as he works in accountancy , anyway his solicitor used this to lever him a much better deal0

Thanks to everyone who replied
It seems like I need to work out if its worth pursuing.
Shes also not included a property she owns which would be disputed as to whether it is matrimonial property but I would have thought that if it is disputed then it should be included and then for the court to decide?0 -
Yes it would be fraudulent not to declare everything she owns, even those that she has a sole right to.0
