Hi, I have drafted my letter acknowledging my non-compliant LBA as per Daisy's great advice, please can someone cast an eye over the content to make sure I've covered everything I should.
Can PM or post part of body?
Thank you0 -
Hi, I know it's really busy on here and there's a lot of people in the same predicament as me, but would really appreciate some help with making sure my letter is ok and contains all the points I need to fight my case.
I know I'm probably being a wimp, but this has really scared me
Thank you0 -
Maybe try asking on your original thread about your fake PCN if you have one? This one tells us nothing. Also you didn't add a reply on Daisy's thread which is what I advised & pointed out you should do, when I replied on your actual PCN thread...so she won't have seen it if Daisy hasn't been on here much.
Also neither Daisy nor myself are able to deal with pm's at the moment, both for separate personal reasons taking up time and energy. Others may be able to look at it but if not then post it on your original thread so people can see the detail of the case.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi I am not accepting PMs at the moment but if you want to post your acknowledgment here, I'll be happy to check it over.

Just read the 'Letter Before Intended Litigation' on your other thread.
Sorry, but that in no way qualifies as a Letter Before Claim! It isn't even worth an acknowledgement!
Here is a letter I drafted for another poster (different solicitors and parking company - similar pathetic letter).
I suggest that you change the name of the sols and PPC (and your name, obviously) and just send it off.zzzLazyDaisy wrote: »JMW Solicitors

Dear Sirs
UKPC v [Name]
Impending Court Action
Thank you for your letter of [insert date], the contents of which are noted.
The alleged debt is disputed and any court proceedings will be vigorously defended.
Please therefore provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct:
http://www.justice.gov.uk/courts/procedure-rules/civil/rules/pd_pre-action_conduct
I confirm that I shall then submit a formal Response within 30 days of receipt.
Please note, a refusal to comply with the Practice Direction will result in an immediate referral to the Solicitors Regulation Authority for breach of the Principles contained in the SRA Handbook version 8, published on 1st October 2013.
Yours faithfully

Hello
Last month I wrote about my ongoing issues with UKPS, DRP and Zenith after a parking charge issued in November 2012 when a car was parked in a car park when it said it was closed. There was no barrier to stop parking. The car park has since become pay and display. At the time, there was an attendant usually present who gave a raffle ticket to park all day, but no machine.
We have had 7 letters from UKPS, DRP and Zenith which we ignored. The we received the below:

We replied using the great advice from Lazy Daisy and others, but now we've had this letter back.

Please could I have some advice what to do next?0 -
You seem to start a new thread each time something happens - this is your third thread concerning this parking charge. It is really important that you continue to post on your original thread, as people need to know what has already happened in order to help you. I have asked Crabman to merge your threads.
With regard to the letter, although it is from a firm of solicitors, they are acting as debt collectors, and the letter is NOT a letter before claim. Normally I would have advised you to ignore it, but as you have already engaged in correspondence with them, I suggest that you send the following letter:
Name
Address
Date
[Insert their reference number: xxxx ]
Dear Sirs
Parking Charge Number xxxxx
I refer to your letter of [insert date], and earlier correspondence.
Firstly, I have no intention of paying the money demanded by your client, and any court proceedings will be vigorously defended.
Second, should it be your client's intention to start court proceedings, you must provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct:
http://www.justice.gov.uk/courts/pro...action_conduct
Please also note that a failure and/or refusal to comply with the Practice Direction will result in an immediate referral to the Solicitors Regulation Authority for breach of the Principles contained in the SRA Handbook version 8, published on 1st October 2013.
In the meantime, and in the absence of a letter before claim, you should place a note on your file to the effect that this charge is disputed and your firm is required to cease and desist all further contact with me.
I trust that I have made myself clear, and I suggest that you take your client's further instructions.
Yours faithfully

Thank you Daisy, that's really helpful.
Sorry, I'm not used to posting on forum's ans wasn't sure how to go about updating info or whether I should start a new thread.
And thank you to Crabman in advance for merging my threads - do I need to do anything else?0 -
