Ukps (nw) pcn

Hi all, this is my first post on here, so please excuse me if I'm covering old ground!

Last November, a relative of mine got a PCN for parking on a pay and display on a Sunday morning. She was late for work, but the car park said it was closed Sundays, there was no attendant or machine for her to get a ticket from, but also no barrier to prevent her from parking there, so in her haste to get to work she parked there anyway.

We then received a PCN from PCS and this has been followed by the seemingly common trail of 7 letters from PCS, Debt Recovery Services and Zenith collections which, on advice, we have ignored.

Today, we have received a letter from a solicitor in the town where we live headed 'Notice of Intended Court Action'

The letter goes on to say that their client UKPS (NW) has instructed them 'to issue court proceedings without further recourse to you'.

Please can someone advise on where to go from here?

    Please show us the letter, who is it from? Please attach a broken link so we can read it (i.e. remove the http:// from the URL).

    And when you got the letter from PCS, what was the gap of time between the day when the ticket was on the windscreen and the day you got PCS' green letter? Was that letter headed up 'Notice to Keeper' or was it 'Notice to Owner'?

    Hi, thank you for that, think I've done this right, hopefully link below will work.

    We received the first letter from PCS on the 12 March 2013, the parking charge date was the 25 November 2012.

    The letter says 'Notice to Keeper or Hirer'

    That joke of a letter is not a compliant notice before claim, but it needs to be responded to, will grab some links for you post them here later, unless somebody can do that. It search this forum for notice before claim/action to see a thread by Daisy on here

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    No, because that only gives you less than seven days from the date of their letter, in reality they are giving you ONE DAY to respond, seeing as the normal period allowed for 'service' (post) is two working days and they posted it, at best, on Thursday (assumes service to you on Monday).

    Nothing about the Practice Direction on there at all, no particulars nor reason for claim, nor breakdown of the £149, NOTHING. This reads like a debt collector template letter - and yet it is on solicitor headed notepaper so see what zzzLazyDaisy says about responding.

    Have done letter using the brilliant advice given by Daisy and others, how do I get it checked to make sure I've included everything I should have?

    Anyone able to check it over for me?
