Mobile Phone deal

I have just signed up to a new mobile phone deal over the phone.
If I dont like the phone when it comes they said I have 7 days to exchange the phone.
My question is if I find a better deal elsewhere or a better phone can I cancel the new contract. (would it come under distance selling regs) also I dont know much about distance selling regulations.

    It depends ... if you use the service then your cancellation rights under DSRs are removed. (I'm assuming it's a mobile contract with "free" phone that you're meaning).

    Beware the terms, It may state the 7 days return policy only applies if you dont activate the sim by inserting it into the phone.

    So do not put the sim card into it.

    Is it 7 days to choose a new phone but the contract stands whether you have a phone or not?

  • they are sending me a new nokia. If i dont like it they said that I could exchange the phone to a different phone. I am just wondering if I could cancel the actual contract if i dont like the phone or if when I read the t&c i dont agree with them?

  • I'm pretty sure you can cancel and return it for any reason whatsoever. The rules apply because you have not been able to examine the phone in person, so if you don't like it for whatever reason you can send it back. However, as someone else said there may be some t&cs that invalidate this if you have activated the phone or whatever, but I don't think that is necessarily the case.

    Pretty sure that will be the case for the service contract.

    There will almost certainly be a term in the T&Cs that the OP has agreed to stating that as soon as the sim is used then that will signify the user agreeing to the start of providing the service.

    DSRs allow for the cancellation period to be terminated upon the start of the service if the buyer agrees.

    Anyway op, the time to look for the best contract is before agreeing to anything... not afterwards.
