NCP parking in Milton Keynes

I am new to Forums so please be nice.
I had the usual MK parking problem a few months ago (parked in the small corner of Milton Keynes car park administered by NCP but bought ticket from MK Council).
I have read many threads and followed the advice to completely ignore all letters. Bit worried by 2 things though so advice please.
1. One thread said that debt collectors came to her house and clamped the car - can this really happen?
2. Latest letter from Newlyn says that case will now be referred back to NCP to follow court proceedings - will this happen as I have not prepared for a case and cannot afford a solicitor or fine.

    You have been reading random threads about Newlyn but scaring yourself for no reason!

    What you may not have noticed is that they also have a separate bailiff arm. So you have read a Newlyn's bailiff thread where you read about clamping - completely irrelevant to your case. No they cannot clamp your car over this, that would be illegal now.

    NCP don't do court so I suspect these are the last few letters in the chain. Come back if you get actual court papers (almost unheard of for NCP) or if you get a 'Letter before Claim' from NCP themselves or their solicitor. That would need a considered response and you DO NOT use a solicitor for a small claim anyway, nor does it cost an arm and a leg, nor would you necessarily lose at all. Two cases on here from firms that try court occasionally (CEL and Excel) were won in court by the drivers, this week just gone and are on the forum page two or three). But as I say, NCP tend to just collect money where they can and don't chase the rest except by scary letters like you are getting.

    Ignore Newlyn 'Debt Collection'.

    But next time you get a fake PCN the current advice is to appeal and then win at POPLA, with forum help, if this was England/Wales.

    BTW NCP do occasionally take people to court but they are unlikely to do so for a long time as when they lost the last case they wound up paying the motorist's costs of nearly £90K & probably an even larger sum for their own legal costs. This was admittedly an unusual case but NCP were so utterly in the wrong & were rightly punished

  • Thanks nigelbb. This situation in Milton Keynes seems so totally unacceptable I can't understand why it has been allowed to continue for so long. Being a bit of a newbie on threads I did not go down the Popla route as I thought the advice was to ignore everything which I have done. I just hope they don't decide that mine will be the next court case...
