The council woman has literally told me she knows i'm paying, the payments are fine there is no issue with the account and the council wants the liability order just in case.

That makes no sense to me, also the woman who emailed me today said:

We are now able to make a weekly arrangement with you that will be secured by the liability order that will be granted in court on 28th October. You do not need to attend the court and a copy of the arrangement will be posted today.

But i had already made the payment arrangement with them months ago! That i paid every week... She says the liability order SECURES the payments!?
None of it makes sense to me.
How much is the liability order costing you? Around my way they aren't that high...£61.00 for summons and liability order.

They just want it so they can enforce payment if you fail to pay. You can attend court and show them you have a payment arrangement and the order shouldn't be issued...you'll need to have this in writing before you go. If you don't already have it then I'll doubt they'll backdate it.

You said 'I got my bill and put it in a drawer and carried on making my payments.

I got the impression that you didn't actually read it before you put it in the drawer and just carried on paying what you had been paying before.

Did you say you were a University Student......
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • That's irrelevant you are just trying to be insulting.

HappyMJ around the same price down my way too. Just seems stupid they want one now, i haven't once defaulted since making the payment arrangement. Could be purely for extra money off me! Haha. However they do charge an extra £20 to me if the liability order is granted, which i've tried finding some info on and all i can come up with is they only cost £3. :-\ Thanks for your answer.
  • Not sure how to close the thread but i've got an answer thanks.

The magistrates court charges the council around £3 each to issue each liability order. The council adds on a percentage of the costs of sending an employee to the court to process these orders so it comes to about £20.

If you have a payment arrangement in writing that you have kept to then appeal to the council and if that fails go to court. The magistrates might agree with you....you never know.

Glad to you read that you've now got yourself a phone ....:)
  • I expect they were able to borrow a phone to make the call.

OP although you were initially given a figure over the phone when a bill was issued this would have given you the correct payment and a break down on how and when to pay. If you pay less than the required amount they will then ask for the bill in full.

If you can't pay it in full then I expect they will ask for payment in monthly amounts anyway.
