Marble fireplace cracked help

I bought a marble fireplace fifteen months ago. It has cracked badly and a piece of marble has actually came away, I phoned today and was told they will ring me back on monday, as it's over a year what are my rights can i demand its repaired or replaced.

    Depends somewhat if it's mechanical damage, inherent from new, etc.

    What part of the fireplace is damaged?

    Is it at all possible that someone could have broken it? Are there a few of you living in the house? Do you have lots of visitors? Has anyone else ever been in the room the fireplace is in without you around?

    A reputable shop then will be fair?
    It's usually better to pay by credit card, you get extra protection.
  • Did the crack occur when the fire was in use?

    A few years ago, I purchased a marble surround for a gas fire and this developed a crack about a year later.
    It turned out that when the fire was installed, one piece of insulating material had been left out, leading to the top of the surround getting far hotter than it should have done.

    As the fire and surround were purchased and installed by the same company, there wasn't any dispute over who was to blame and a new surround was fitted free of charge.

    Who fitted it?
    What fire is in it?
    Was it cemented in place, hearth level and back filed with cement, back panel bonded to wall and insulated behind and then sealed around all edges and internal cut out?
    Has anyone stood on it?

    You will have to prove that it is fault from new, is an inherent fault, you cannot just demand it's replacement. You will have to prove fault is theirs.

    Marble is delicate, it can be cracked quite easily, just dropping a picture frame on it from the mantle piece can crack it, if it has not been sealed own correctly.
