Yes she would have paid it if in arrears as she has paid gas, electric and phone bills.
It is a matter of principle, why should a company get to keep this? As I mentioned banks have procedures in place for such events. no problems donating it to charity.
The housing association has got a procedure in place - they need a statutory declaration to conform that your wife is authorised to deal with the estate of the deceased.

I am very sorry for your family's loss Paggy, but have to admit that I would not be bothered to kick up a fuss for the sake of £40. It's such an insignificant amount really. If you tried to take any kind of action, I can't see anybody taking you very seriously.0

Put your principles aside! There's more to life than quibbling over £40 that you haven't lost.
Would your MIL want you to go through all of this to get one up on a company who helped her out in a time of need because of your own principles.
In the grand scheme of things it is minor. If it was 4k then maybe you would have a point but £40...really????? Hardly life changes money.An opinion is just that..... An opinion0 -
the point is the OP does not need to kick up any kind of fuss ,
just get the required ID and the HA will give them any money due in regards to MIL's overpayment

HA procedures/rules or whatever you want to call them, are there for the benefit of the OP and others in this kind of situation to avoid fraud,
if the OP doesn't want to abide by those rules then forget about the money, it really is that simple.0 -
Isn't it possible that this will be an underpayment rather than an overpayment, as rent for the notice period is probably due. this is quite possible but as the OP says its an overpayment, i have no reason to doubt them,
if it does turn out to be an underpayment its a hard one to call , some HA will invoice it as a loss, others will insist on it being paid.0 -

but the OP has already been to the housing association and they want a form signed by a solicitor to get the £40 back. as he doesn't want to pay for a solicitor it's come to an impasse.
I suppose we can only pray that somehow the OP can overlook this £40 and move on.
On the bright side I'd imagine the people in the housing association have a story to tell their friends....0
