  • Just an update to this. Contrary to my negative thought Tesco were working behind the scenes on my complaint. A few days after submitting the popla appeal the company who manage the car park in question on behalf of Tesco contacted me. They told me that B&M hire the car park from Tesco and it was they who employed G24 not Tesco. Further they did not have permission from Tesco to do so.

    The upshot of this was not only did my family member get their ticket cancelled, when I visited the car park about a week later, although the signs within the car park were still there the entrance sign had been removed and the cameras had been taken down. Over a month later it's still like that. I presume Tesco have told B&M to get rid of G24. Couldn't have worked out any better!

    I wonder what will happen about all those who've paid this outfit?

    Any chance of raising this with your local press OP as that seems the best way of raising the fact locally that many people have been duped by a con.

    Perhaps B & M should be brought to task on this? Do they have a Facebook page?

    Now that's what I call a result, well done!

    Was the company Colliers on behalf of Tesco? They don't seem keen on PPCs.

    Could you tell us which retail park this one was, please, as there may be people who have paid fake PCNs here who could actually pursue B&M for a refund!!

    This vindicates my long held view about leaseholders needing permission from landholders to form a contract with a PPC and why it is in my core POPLA appeal points thread. So even though the PPC can produce a valid contract with a 3rd party, if that 3rd party does not have rights themselves, then the contract is invalid.

    Please, regular advisers, make sure that any POPLA appeals you help with contain the requirement that the PPC can show a full trail of authority back to the actual landowner.

    Yes great news indeed. I have since moved but I did see an online article from a nearby town regarding the same car park and people compaining when I was first researching all this so I'll see if I can find it again and drop them a message. The car park is in Boston. Sorry not sure who the company was. I don't think the email mentioned it.
