Fell Asleep on Motorway Services

Great result Superscrooge. Glad I was able to help in a small way.
I noted your attempt to PM me, but I do leave my PM folder 'Full' as if it's not that I'm overwhelmed by PMs which really does take me away from helping more generally on the forum.
Also OPs lose out on other very valuable inputs from contributors much more able than me to offer excellent advice.
Well done, once again. :TPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Superscrooge wrote: »I've just got my popla appeal result back and my appeal has been allowed which is excellent news.
Until it happened to me I had no idea that Roadchef fined their customers £90 if they remained on the motorway service area more than two hours. I did email Simon Turl, CEO Roadchef as suggested in an earlier post but Roadchef were only willing to reduce the fine to £17 which I wasn't prepared to pay.
The crucial part of the popla assessors decision is below.
The Operator has not produced any evidence to demonstrate that it is the
land-owner; or, that it has the authority of the land-owner to issue parking
charge notices at this site. Once the issue is raised by an Appellant, it is for the
Operator to demonstrate that it has authority, and a mere statement to the
effect that it has a contract will not be sufficient.
Consequently, I must find that the Operator has failed to produce sufficient
evidence to refute the Appellant’s submission that it did not have authority to
issue a parking charge notice.
Accordingly, I must allow the appeal.

I would like to thank Umkomaas and Coupon-mad for their excellent advice in helping me draft my appeal.
Best Regards
Hi Superscrooge
I had exctaly the same in a MOTO service area, more or less for the same time of the morning and for 72 minutes after the free parking and from the same company, CP Plus.
Anyone that could tell me if it is ok to use the same appeal, changing only the details, place, time, date, car, etc?
Thank you very much.
I got the POPLA code and I am in panic.
Thanks again0 -
Why are you in a panic when several example POPLA appeals are linked in the NEWBIES READ THIS FIRST thread? there's a whole section linked under 'How to win at POPLA', and we win 100% of the time on this forum, every single case for eight months, not just this one!
Have to say though, the above POPLA appeal for a MSA was up there with the best, especially al the stuff about signage! You can certainly use a version of what you find in the threads here. Then come back and add your success in the 'POPLA decisions' sticky thread in the end!
I recommend everyone this month does their POPLA appeal online, due to postal delays.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
