I was involved in an accident 9 years ago...unfortunately not known to me was my ex wife had cancelled the insurance on the car I was driving. I went to court...£400 fine and 6 points....I have not heard anything since then 9 years ago. That is until this month being bombarded from calls from Sheffield asking for payment of £9500 by credit card or any means. I have asked for proof in writing of their so called numerous attempts to contact me by mail at my home address ( the same for 7 years ) they refused today and stated they are under no obligation to provide this as they are acting for MIB. Am I correct in thinking this is time barred? Before I contact my solicitor.....many thanks

  • No idea what the payment is for as they refuse to put anything in writing. I can only assume its for the damage to the other vehicle....no one has ever put anything in writing to me nor I to them after the court. That as I said was a little over 9 years ago....they are trying it on I think, but I need to know my legal standing before I forward this to Office of fair traiding and the ombudsman...

    I think they can only claim up to 6 years. Sounds like a try on. Well you aren't going to pay over £9K with nothing in writing anyway so tell 'em to go take a hike.

    If there is a debt it never "dies", but the creditor only has 6 years to commence legal proceedings to get paid.

    That doesn't stop anyone trying to get you to pay them by other means!

    Presumably someone's bought the old debt for a few pence in the pound and is now taking a punt on swing how much they can collect, if anything. Asking you for the money isn't illegal as you still owe it, but if you tell them to get stuffed there's not a lot they can do about it other than ask you again as it sounds like they're well out of time to commence proceedings.

    Look at the debt free wannabe board and you will find links to the "prove it" and "statute barred" letters, or maybe just cross post there.
