Asda Order

Hi all,

I ordered a folding bike from Asda on Sunday with an expected delivery within 3 working days. Yesterday I called them, they said my order was supposed to arrive on that day but they would call the supplier and check, and call me back.

They called back saying the supplier had not received my order from Asda.

Note: I need the bike to arrive by Friday at the latest as I leave for university early Saturday morning.

After asking to speak to a manager, explaining that I was furious, I was put through to one who said they would mark my order as urgent and would call back today with information.

I'm not too sure how my rights stand, but any ideas on what my next stance should be?

    Did you tell them time was of the essence? Can you have it delivered to Uni after you arrive?
    Please forgive me if my comments seem abrupt or my questions have obvious answers, I have a mental health condition which affects my ability to see things as others might.

    Yeah, I told them it was impossible for me to receive the bike at the current address after Friday.

    I could in theory collect it from uni but I wanted to test it before taking it/refresh my bike riding skills and I may be strapped for time once there.

    you don't need to refresh your riding skills...

    its just like riding a bike....

    Sounds like best case scenario Asda will offer a gift voucher as an apology. If the order is fulfilled by an external supplier and not Asda it can be difficult for them to speed up the ordering process!

    I'm not an expert by any means but here's my general view / understanding...

    Unless when you ordered the bike ASDA said something like 'GUARANTEED delivery within three working days' OR you made it clear to them at the point of order that it was essential that it was delivered by a particular date and they acknowledged and accepted that then ASDA haven't really done anything wrong.

    Assuming that neither of the above was the case, then if you don't want the bike if they can't deliver by tomorrow, then you can appeal to their better nature to see if they'll cancel the order and refund you when they phone today, but I don't believe you have any rights to demand it.

    Distance selling. Op could cancel and demand a refund under DSRs but the company can take up to 30 days to refund.

    It sounds like the OP doesn't want a refund but wants the bike delivered in the agreed time. I don't see how this is possible at is impossible to enforce Asda to send this bike in its agreed time.

    As the OP says if its delayed they can collect it from uni. They would just rather not.
