Reclaiming Credit Card charges from account passed to DCA.

Hi there,
I had a number of credit cards with MBNA, Capital One and Vanquis which, due to financial difficulty, were all passed to debt collection agencies and have now been paid off through those agencies. I'm just wondering if it's still possible to reclaim the charges now that these accounts have been sold on and closed?
Thanks.

As per the MSE article, you can claim back up to 6 years (5 years in Scotland)
Financial hardship has nothing to do with it. It's all about a claim the charges were unfair. Essentially if they were over £12 each then the OFT (and hence the FOS) will accept they are automatically unfair (unless the provider proves otherwise)
For charges £12 and less each, I doubt the card provider will agree, so the question is, are you prepared to take this to court?0 -
Hi there,
Thanks for the reply. I was more concerned as to whether the fact that they had sold the debts to debt collection agencies and that these debts had now been settled. Would this affect my ability to claim from MBNA, Capital One and Vanquis?0 -
Whether or not you have already paid the charges does not affect your right to attempt to reclaim fees you believe are unfair.
