Hi,
Just Wondered if anyone as had any success when claiming back bank charges from halifax? i haven't yet sent the form off but i'm thinking about it as i use my overdraft every month and get charged arounf £60 a month. With recently having a baby and my parnter losing her job its getting harder and harder to repay the overdraft every month and the overdraft has become just another bill. hope theres people out there that have had success stories i would like to know there out comes.. Thanks.

Since the court case was won by the banks in 2009, the only times people get refunds now are goodwill offers from the banks. Typically first time errors leading to a charge or those who meet their financial hardship criteria.
Use of overdraft would not be financial hardship. Losing a job would allow them to start looking at the account but it would have to be along the lines of continuously in overdraft with no obvious signs of being able to escape it, no luxury items being spent (so no Sky TV, mobile phones etc), Depending on amounts, some may require you to have arrears, defaults etc.
If you drop in and out of overdraft each month then reclaiming charges is unlikely but if you approach your bank and explain the situation, they may offer alternatives (such as suspending charges for the next 3 months).I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. This MSE article explains how to request a refund of bank charges.

As you can see, it really is only possible if you are in genuine financial hardship (or a 'first offence', or the charges were not applied in line with their terms/tariff)
For further details of what constitutes financial hardship, please refer to this sticky thread:
