Bank Charges - Due to Vodafone or The Carphone Warehouse

[FONT="]Hello
Someone close to me has been having trouble with trying to reclaim bank charges It all started when she had taken out a new phone contract.
She went to her local The Carphone Warehouse and purchased a new mobile phone/monthly contract package via Direct Debit, using network provider Vodafone. Two weeks later she received a letter from her bank stating her account was now overdrawn due to Vodafone taking out the first payment.
She went into her local branch and she was given a printout of the charges for being overdrawn. Without going into who’s blaming who, Vodafone are adamant The Carphone Warehouse is to blame, and vice versa
She contacted Direct Debit who told her, she should have been given a minimum of 10 working days advanced notice from Vodafone of when they intended to collect the first payment from her bank account. Plus she was entitled to make an indemnity claim at her bank.
There’s never been any advance notice provided by Vodafone or The Carphone Warehouse in the way of email, letter or verbal what’s so ever
With the information Direct Debit had given, she wrote an email to Vodafone explaining what had happened to her. She gets a phone from a Vodafone representative stating it was The Carphone Warehouse who was to blame and not Vodafone.
I would like to ask you who really are to blame? Direct Debit states Vodafone. It’s this has gone on too long and she wants to take it to a small claims court to recover the charges amount from VF or TCPW

They need to give 10 days advance notice of any changes to the amount etc.
The initial payment (if it was just a for a flat per month fee) is considered having been advised at the point of signing the DD mandate when purchasing.
When did Vodafone actually take the payment after purchasing the phone contract?0 -

Who's to blame? Well at the risk of sounding judgemental (but you are asking), then I would say your friend is to blame for not having sufficient funds available in her bank account to meet the terms of the contract she entered into.
I suggest she refers to that contract again.

Without going into her monthly out goings/wages etc each month. Vodafone should have gave her notification to when they were going to take out the very first payment as stated by Direct Debit.

Hi Daniel182,
I did explain the reasons for not doing so earlier in the week.
However, I did try to call the customer who you've posted on behalf of yesterday but wasn't able to reach them.
As such, I sent them an email asking them when they'll next be free to discuss things further.
Kind regards,
Lee
