    However doesn't clarify whether someone that does not hold a beneficial interest in a property that is married to someone who does, could buy with HTB and then allow their spouse to rent out the old house and move in with them.

    TBH I can't see any way of preventing that scenario.

    The lender can "control" the property on which its loan is secured, but not the one owned by the partner.

    On HTB - EL consent to let is only granted in exceptional circumstances. For example, service personnel being posted overseas and only then for a limited period.

    Agreed.

    And that, I think, is what the OP was getting at as one of his questions.

    It'll be rare, admittedly, as most spouses will have a beneficial interest in joint properties.

    But for the few who don't, it's an interesting loophole.
