Feedback on Nuttall Wills and Trusts

Hi,

I am currently looking into getting a will drafted and have been contacted by Nuttall Wills and Trusts. From what I have been able to research they are a fairly new company that was started earlier in the year but other than that my searches have drawn a blank. Has anyone had any dealings with them?

This is obviously a very important document for my family's future so I'm suffering a bit of paranoia that I get it right.

Any information about NWT or advice on the drafting of wills in general would be greatly appreciated (I have already read the section on MSE).

Many thanks,

C.

First thing I note is they are not a member of the Will writers institute. They claim to have strategic partners in Minster Law which when one looks at their website they specialise in accident claims and pass on their will writing to other firms around the county. They have only been in business since June or at least only a LTD since June. Their testimonials look iffy as well. All are common names and therefore you cannot trace the people to see if they are genuine.

More concerning are there claims on what if you die intestate page. Some of what they say is just downright wrong. http://www.willsandtrusts.biz/what_happens_if_you_die_without_a_will.html

Based on that and that alone if this was me looking to have a will written I would leave well alone.

OMG even the first answer in their FAQ is incorrect.

  • Thanks for your opinion, something for me just wasn't sitting right. They may be everything they say they are plus you only generally hear bad experience posted on the internet (which I haven't found anything referencing them) but with something as important as a will I don't think I'll risk it.

Chase I agree totally however they havent been in business long enough to have bad publicity. I note they havent responded to my email asking them certain questions and informing them of the errors on their site which worries me as well.

Candid8one, if you are a company rep there is a protocol you need to observe before posting: http://www.moneysavingexpert.com/site/forum-faqs#response

Funny that I did contact the company explaining that their website shows a lot of innacuracies and funnily enough they did not reply nor has the website changed.

I can also back up all I put and if you actually read my post you will see I said the company had only been in business a short space of time or at least only as a Limited company. I think you really need to read everything I have put.

Interesting you make the claim that you dont cold call but that you respond to details passed from market research companies when someone has expressed a wish to have a will. I guess that is you being pedantic because to me that is still cold calling. The person did not specifically say please call me.

Also using a survey to obtain potential clients shows how well known your company is.

Now maybe you could explain why you are not a member of the IPWS which I would have thought would have been one of the first things any will writing company would have wanted to be a part of.

Secondly can you answer my comments about Minster Solicitors? Again that is fact taken from their own website.

    This is from your website
However, the intestacy rules may not work in accordance with your wishes if they don't allow for your particular situation. Here's just a few examples of the sort of things that the normal rules of intestacy don't allow for:

You have children from a previous marriage
Your estate is large and may be liable for Inheritance Tax
You have children, but you wish your spouse/civil partner to inherit all of your estate

All of the above are wrong. Now if I was looking at you to write my will and if you dont understand the laws of intestacy how can I be confident you will get my will correct and legal?

Just to correct you anyway and who knows maybe you will contact Minster Law and who will then contact a probate solicitor and confirm the following.

Having children from a previous marriage does not stop them inheriting from an intestate estate so long as their is documentary evidence in the form of a birth certificate naming you as their parent.

Even a will cannot stop IHT

If you die intestate the first person who gets a claim to the estate is the spouse or civil partner subject to the estate being under 250k after which the first 250k is paid to the spouse half of whatever is left is placed into trust as a life share for the spouse or civil partner and the other half paid to any children of the union.

Now I really cant be bothered telling you of all the other inaccuracies within your website however let me tell you this an about us page would normally state how long you have been in business plus other details such as the main players within the business.

It is also interesting that after extensive searches online there is nothing to suggest you have been in business any longer than the date of your incorporation. Also I find it hard to believe that a will writing company would not be incorporated at a very early stage especially when a court can declare a will void for the slightest error in its making leaving the owner of the business at risk of losing everything.

I suggest in future before you come on here making accusations and comments that you at least know the laws of what you are supposed to be a professional in.

Just to show how my research skills are. Candid8one is the managing director of Nuttall Wills and trust. I know his name but I shall dispense from posting that. He has been the MD since 2009 prior to that his employment record shows he has been in sales since leaving education. According to a directors check he is not actually listed as a director with companies house (although this may be inaccurate since there is little listed with companies house in respect to this company)

A directors check shows the above's father is the only listed director and he is 78 having been born in 1935.

There is nothing to suggest that this company has been about for 21 years as the above suggested in fact the earliest date of mention for this company is 2009 in the aboves own biography however with some more digging it would seem that the above is now involved with two listed companies. Nuttalls wills and Trusts limited and N.W.T. Limited. The first is registered to the Gloucester address found on the website the second is registered to an address in Newport. This second company was originally called G8 Consultancy. This was a company designed to develop among other things sales strategy for FTSE 250 companies. This company is showing a book value of just close to -65k and as submitted a request to strike off this company. Another company they owned was voluntarially struck off the ltd register and disolved with a book value of -26k

Also interesting is that the above person is the owner of all the registered domains associated with this company. Do I need to dig any deeper?

Even when you got to a solicitor check he really knows what he is doing, I have recently had to sort out a will, that even I could see was partially intestate, as soon as I read it.
