    Sadly I am unable to assist with how the ticket was issued or in getting it cancelled for you – that is not within my powers.

    What I can do though is investigate why the Notice to Keeper (NTK) was sent to you so long after the parking incident. As you point out this is potentially a breach of our Code of Practice and I need to better understand what has happened here. It would be very helpful if you could send me a copy of the NTK that you received as well as confirming the date of the parking incident. Upon receipt of this information I will ask one of my team to look into this matter for you and they will respond with their findings.

    One last question – how did you get my e-mail address? Not hugely important but it would be helpful to know."

    It's hardly difficult to guess at such an obvious email address, you'd only need 3 or 4 attempts at doing a permutation on his name plus the very obvious @britishparking.co.uk.

    Regrettably PPC-land isn't awash with genius (or ingenuity)!

    But I wouldn't bother with a reply to the question - the BPA are adept at the side-step, so why not?

  • Please see below the response I have received from the General Manager of the cinema.

    "Thank you so much for your email regarding your recent visit to our cinema and for bringing this matter to our attention.
    Firstly, please accept my sincere apologies to you for the stress and upset that this incident has obviously caused.
    I too am disgusted to hear of your treatment and equally outraged that it has happened to one of our customers.

    CMS are employed by the landlord of the site to monitor the car parks and as a tenant of the landlord ourselves, Empire Cinema have no control over the way they operate, however I will immediately escalate my concerns to our landlord and request that the notice be quashed and any further harassment for money stopped.

    I will be back in touch as soon as I receive a reply from our landlord".

    I am now trying to establish who the landlord is!!!!!

  • Just an update; nothing heard yet from either the BPA, Roxburgh, Landowner or CMS. Still waiting for the LBA to land on my doorstep but hey ho, they say no news is good news so I am keeping my fingers crossed that they have given up on me.

    "Dear ******

    We have contacted the operator in regards to your complaint and can advise as follows. The operator has been made aware of the need for 40% discount and this was immediately changed to ensure they were compliant.

    The operator has confirmed they did apply for your keeper details from the DVLA after the 28 days had expired for appealing. However, the operator experienced a delay receiving the details back from the DVLA and this is why it took so long.

    Please be aware this operator are no longer members as of the 5th November 2013. We do not believe there has been a breach of our Code and therefore consider the case closed.

    Thank you for bringing this matter to our attention.

    They have gone into Voluntary Liquidation. With Insolvency Practitioners now in charge they probably don't have control of their website.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Why don't you write once more to the General Manager of the Cinema (don't phone, you want a paper trail and attachments). Say that, for his information, this firm 'CMS' have been kicked out of the BPA as well as breaking the Equality Act, and what is the landowner going to do to restore your faith in their customer service in this leisure park now that they have an unregulated rogue firm on site? Send the Gen Manager a copy of the BPA email and a copy of the official complaint which I assume CMS never responded to. Tell them that the landowner is liable for the actions of their agents to the Equality Act breach is the landowner's responsibility and if the rogue PPC won't respond then the very least you expect is the landowner or their managing agents to step in under these illegal circumstances of harassment for money.
