Online order sent wrong

Hi hopefully someone can help me, I ordered a pushchair online from the title description and picture it was black framed with black hood, they actually a sent me a silver framed with beige hood. I have spoken to their customer service who said the description was wrong and that the company do not make a black frame anymore and that the item I have is a newer version. This was a lie the item i received is an older version of what I thought I was purchasing and the pushchair company still manufacture black frames (the company I ordered from are selling an identical black framed one with different hood still) They have said I can have a refund but I just want what I have paid for. I am now stuck without a pram and they say a refund can take up to 30 days, where do I stand? Am I within my rights to requested the black frame they lead me to believe I was paying for but didnt supply?

  • You can't force them to give you something they don't have, but you can certainly ask. If the pram is available from other retailers but costs more money you may he able to claim the difference from them under loss of bargain after breach of contract. If not then you haven't got a loss to claim for so the refund is all you'll get.

    As for the timescales for the refund, the Distance Selling Regulations give them a maximum of 30 days. The Sale of Goods Act doesn't specify a timescale.
