Ebay Distance Selling Regulations Question

Hi everyone, and thanks in advance for any help.

I have just purchased a projector screen which i cannot actually get up the stairs in my house due to it's size! (yes i hear the laughter from here!) The wall it was meant to go on is the right size, but the access won't allow it to go in.

I have asked that the seller ( a business on ebay) accepts a cancellation of the order, and i am happy to send it back at my own expense. The box has been opened, but the screen has not even been taken out of the box, plugged in or removed from it's protective foam.

The item was a buy it now, not an auction.

I have told the seller i will shrink wrap the box and send it back, but on the returns policy on ebay the seller has stated that they do not accept returns for 'wrongly bought items'.

I have messaged saying that it was not wrongly bought, but that it is just unusable.

Am i covered by the DSR? I perdict that they are goiing to kick up a fuss as i've had no reply to my messages as yet, and their call centre just has an answerphone, and they haven't bothered to call me back as yet.

I would accept a smaller screen in exchange, but they don't have one listed. It's literally about 10cm too big to get round the top of the stairs!!

  • Yes you are covered under DSR for a change of mind return.

    With eBay being in the equation, you may find it difficult to get them to agree to a return. This is the one time when eBay rules hinder rather than help.

    It can sometimes be easier to find a fault with and item and to return for SNAD if you fear a seller will be difficult. I do not like to advocate this sort of behaviour but some businesses on eBay need to be educated and will stick to EBay rules only.

    How about using a ladder and putting the screen through upstairs window ! or if no ladder, some rope and haul it up to and through a window.
