So the bad news or the bad news?
Firstly, the ICO are definitely useless as they’ve written to Barclaycardasking why they haven’t included a ‘Debt Management Plan’ status with themarker. Erm what?? That’s not what my complaint was!! I wanted to know why theyapplied AP/AR markers rather than a default. Looks like I’m getting nowhere. FOS still looking into their part.
Next set of bad news, Tesco Bank are alsodigging their heels in. They haveapplied red 6 late payment markers for 5 years. Despite me sending the ICO guideline page advising against this, they aren’tprepared to back date a default as they have correctly recorded the creditfiles. End of.
I think I’ll resign myself to 6 years ofmisery!

Well I think it's time to finally give up.
ICO was useless and FOS cannot uphold my complaint as they feel Barclaycard have treat me fairly by accepting reduced payments and reducing interest. They consider that an AP marker is less damaging than a default despite my arguments that the former can stay on your file (technically) indefinitely whereas a default only lasts 6 years.
Anyway it would appear this is an end to the matter and I now have to wait 6 years before even considering a remortgage.

I tried the template letter and got a speedy but not helpful response. Barclays have stated that i need to ring back in 4 years and they will then remove the AP markers and mark the account as payments up to date. (My default should have been six years ago).
I asked that they put this in writing to me but of course they wouldn't :mad:

Not meaning to sound funny but they're lying. They're just dangling a carrot to get you to pay. There's no way they're going to apply AP markers now and remove them retrospectively. It's just not going to happen.Debt at Start of DMP in October 2009 - £45,000 :mad:

I understand the bit about treating you fairly by accepting reduced payments and reducing interest and that technically an AP/AR should be less damaging than a default but wouldn't it be interesting to get a reply from an other lender confirming this?
While it could be argued that applying for a Barclaycard these AP/AR's on your file may have minimal impact what about if you applied for a card with Natwest, Santander, etc? I suspect they'd be more inclined to decline you which in effect is creating a monopoly isn't it?
Maybe someone smarter than me can comment LOL

As one last attempt I've referred my complaint onto an ombudsman. Just wondering if anyone has had any experience with this and if an ombudsman has ever overruled n adjudicator?? Sounds unlikely but I have nothing to lose.Debt at Start of DMP in October 2009 - £45,000 :mad:
