HSBC time barred

A few years ago I complained about PPI that I was sold by HSBC, they made me an offer and I sent the form accepting the offer.

Looking at my statements HSBC never paid the money into my account. It was for a fairly large sum, however at the day they sent the offer my mum died.

Now over the next few months I had tens of thousands of pounds going through my account with the estate, house sale and funeral to arrange.

I've only noticed due to something else, but HSBC are saying they never got the letter and it's time barred. Before I bother with the FOS do you think it's worth pursuing or will they knock me back?

    I would absolutely pursue it with HSBC. You must do it by way of a formal complaint and make it clear that you fully intend to take it to the FOS should you remain dissatisfied.
  • I would send a copy of the death certificate to HSBC explaining that it was only because of your bereavement that you did not follow it up sooner.

    If they still refuse, then go to FOS.

    Under normal circumstances, this would be way outside the referral time frame. I would proceed as first suggested and hope they're feeling charitable.

    I know, they said that they won't deal with it now but I'm welcome to go to the FOS but they might not review it due to the time. However I've not explained that it was due to a bereavement I never chased it up.

    But reading on the FOS they will start to review it and ask the bank if they are happy to continue, if there is an exceptional reasons why I haven't chased this up then they will look at it.

    I hope this falls into that camp. I was kicking myself when I noticed the money hadn't been paid.

    I agree.
    FOS may accept it - particularly if the bank did not explain to the OP that they might consider "exceptional circumstances" and it is only as a result of this thread that they have become aware of that possibility.

    I need to find all the paper work this weekend and get this packaged up.

    Incidentally 3 years ago I also complained about my credit card PPI which they refused, but I tried again a couple of months ago and they paid out. Not sure if this would work in my favour.
