Just received PCN notice from parking eye need help

    Recieved a new letter from parking eye today dated 24/10/13 recieved 30/10/13

    There is no mention of my appeal which i sent by using their website on the 17/10/13. Just that the 29 days are now up and i owe them £85 now to be paid within 14 days.

    What is the best thing to do now. No mention of my appeal or a POPLA reference number.

    Guess ill send them a letter this time repeating my appeal and a request for a POPLA code again. Hopefully this time they will respond to it

    Nope that's normal, those secondary letters are automated. Appears they may have a backlog as I submitted one on the 18th and I haven't had my soft appeal decision yet either. Sit tight and wait for your POPLA code (or soft appeal win :) ).

  • I have had my 2nd letter. Didnt send my appeal until after that. I was within the time schedule. This is my 3rd letter 13 days since my appeal which was sent 17/10/13. They said they would reply within 10 days by letter. It is now 13 days but this letter does not mention my appeal just demands £85 now to be paid within 14 days. which i guess is 7 now as the letter is dated 24/10/13 and it is now 30/10/13

    Same applies. The PPC have 35 days to respond to your appeal from the day they receive it, so no doubt they are a) receiving a lot of appeals and b) working to their timescale, not yours.

    All letters asking for payment are automated based on dates. Same advice applies - sit tight and wait for your POPLA code!

    The BPA code of practice requires that they suspend efforts to enforce the charge whilst the appeal is being dealt with.

    Extract BPA CoP
    22.6 When you receive a challenge about the issue of a
    parking charge, you must stop work on processing the
    charge immediately. You must not increase the charge
    until you have replied to the challenge.

    So you should make a formal complaint to BPA about their breach of the CoP, attach copies of their acknowledgment of your appeal and the demands for money that you have received since then. Copy that letter to DVLA as well.

    I would also copy the complaint to the PPC and tell them that they must cease and desist contacting you about this matter until such time as your appeal of [insert date] has been dealt with.

  • The only response i have had was after completeing their appeal process on their website. At the end of the process it came up with this message below. They havent sent me a letter to acknowledge my appeal or email. Copied the message as they didnt give any reference number to say i had lodged an appeal. Will this do as proof.     FORMAL COMPLAINT AGAINST BPA MEMBER PARKINGEYE LTD
    Dear Mr Clarke

    PCN ref xxxxxxxxx
    Vehicle reg no XXXXXXXX


    I wish to make a formal complaint about ParkingEye Ltd in respect of its clear breach of BPA Code of Practice, para 22.6 which clearly states that once a challenge has been received the company must stop processing the charge immediately.

    I am the Registered Keeper of the above mentioned vehicle.

    On [date] I made a written appeal to ParkingEye Ltd against the above PCN. The appeal was sent via their e-appeals service and an automated acknowledgement was provided. ParkingEye has not yet advised me of its decision on my appeal.

    Since submitting the appeal I have received two further letters dated xxxx and xxx demanding money from me (copies attached).

    This continued harassment is causing me considerable stress and I would be grateful if you would investigate this complaint as a matter of extreme urgency and ensure that ParkingEye complies with its obligations as a BPA member to cease pursuing me until my appeal has been dealt with.
