Need some advice about income support claim

I have been receiving incapacity benefit for four years now and recently made
a claim for income support for me and my partner. I received the decision today
which says I am entitled to £30.35 a week is this decision correct. Shouldn't
my partner also be paid as she has no income coming in. I get the long term rate of incapacity benefit which is £98.45. The decision was based on how much the law says you need to live on. I called up the jobcentre and was told I have to support my partner with my incapacity benefit. Thanks in advance to anyone who can provide me with advice.

A little update I phoned the Job Centre and spoke to an advisor who said that I am wasting my time in asking for an appeal. He said like he shares his wage with his partner I am also expected to share my benefits with my partner which I do, we have about £70-£80 housing costs a week. How am I supposed to support ourselves on £128.80 a week surely there decision is wrong. Also could someone please tell me on how much money the law says a couple needs to be on a week?0

Hi snowman, you should put a claim in for Housing and council tax benefits and ask if you may be entitled to any backdating as you have been on a low income. I obviously don't know the nature of your illness but have you thought about putting in a claim for Disability Living Allowance? that would improve your income and perhaps entitle your OH to Carers allowance if you were awarded high or middle care component. I would check if your local council has a welfare rights officer or ask at the CAB for help with the claim.doing what I do best...trying!!-- lainey :j

Thanks to everyone for there replies, @ lainey stardust I suffer from Asthma, Angina, Diabetes, Renal Kidney Disease, Neuropathy in legs, High Blood Pressure, Poor Circulation, Varicose Veins, Depression, High Cholesterol and have recently been told I was born with weak valves. I have applied for DLA they did reply and say they are going to write to my DR for a report. They have received the report and said they will get back to me. It has been about 2 weeks no reply so far. I will also be having a Heart Catheterisation (Coronary Angiography) to see how many Arteries are blocked and whether I need a bypass or not. I also have a walking aid I can't walk for long.0

If the DWP have said that the amount quoted is the amount the law says you need to live on it may be correct, but you can check this if you go to a Welfare Rights Officer as they should be able to do a Benefits check for you.0

hi snowman, wow you are really going through it aren't you!
I would say you should definitely get DLA and hopefully the high care rate. your OH will then qualify for Carers Allowance. It can take up to 3 months depending on the speed of your doctors reply and if the DLA have a backlog but usually they are pretty quick and you will get backdated to the date on your form. Once the DLA has been awarded, inform the housing benefit people and DWP and you will get your benefits adjusted.
