PPI Claim for deceased father

Hi

My dad who passed away a few months ago was paying PPI on his credit card which in turn we made a claim on to clear his credit card bill.

Would it still be possible to raise claim that the PPI was mis-sold when my dad first took the card out?

I know you can make a claim on behalf of a deceased relative for PPI but unsure if you can still do it if you used the PPI to clear debt.

Thanks for your help

So you claimed on the life insurance element of the PPI and now want to complain it was mis-sold?

Even if it was to deemed mis-sold, any redress awarded would have the amount already claimed deducted prior to pay out.

On what basis would you complain it was mis-sold?

Hi and sorry to hear about your father.

It is possible to complain about the way in which the policy was sold regardless of whether you have claimed in it. However, in the event of a successful complaint, the amount paid in claims will be deducted from anything offered.

It is technically possible for the executor of a deceased person's estate to put in a complaint on behalf of the deceased. However, in this situation it is easier said than done. A complaint of Mis-sale relates to the advice or information provided at the point of sale. So bearing in mind that you presumably weren't there and your late father is, unfortunately, not here to give his account of events, even if there were wrongdoing I fear you'll find it hard to establish a case.

Have you any reason to believe the cover to have been Mis-sold or is this just a speculative enquiry?
