    Makes no difference whatsoever. She has only been employed a few months so can be dismissed practically on a whim.

    one of my other employees found a business card through one of my clients doors advertising a cleaning company with her address on and two e mail contacts (one again which was her)
    .

    It's pretty clear the OP is being used.

    Thats not evidence at all. Anyone can set up a business. I work in an accountancy practice and have done some bookkeeping from home alongside. I can pretty much send business cards where and when I like. Doesn't mean I'm poaching clients from the practice I work for. My business is a completely separate one from where I work.

    Its not a criminal case thats needs positive proof, the fact is she can be dismissed for any reason other than discrimination.

    The card really is the smoking gun and you can be sure she is using the Op's products and equipment, again proof is not needed.

    Get rid now before she does irrepairable damage and get's all your client's.

    She wont be the first person to use established businesses to steal clients and she wont be the last.
  • Imagine if you dismiss her and all of your clients leave because it was her that they wanted and not your business.

    What a worry! At least if your Company is large, it won't be a great % of your customers that are in the know of this employee.

    If you have the business card, keep it and sack her. What more are you allowing to happen under your nose, while paying her (subsidising her) to launch her own business? You are already suffering because she has your client list, costings and ability to bad mouth you (probably some of your materials too).
    Make it direct, and make sure she, her colleagues and hopefully passers by too, know you are sacking her for gross misconduct and you are considering taking the matter further legally. (You won't go to that cost, but weasels deserve a kick up the trumpet).

    Use the email off the business card to try and book her on the day she has requested off. Use a friends or family house and wait for her to turn up.

    She probably wont return to your company and saves you sacking her!

    Job done.
