Returned item - no refund or item

Hi I bought an item and it developed a problem after the first month or 2. Sent item back (they had delivery company pick it up)

That was nearly 3 weeks ago. They keep making excuses - last week it was they had moved warehouse.

Is there anything I can/should do? I played via paypal (but that was in July)

  • They have 30 days to refund. If they don't then you'll need to send a Letter Before Action

    (Assuming they've agreed to a refund. If they haven't then you might be offered a replacement or repair)
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
  • If you had it a month or two before the problem arose it is likely that you have 'accepted' the item and thus would not be entitled to a full refund.

    The seller can then choose the most economical option out of repair, replace or refund (partial).

    If the seller decides to repair or replace the faulty item then under SOGA they must do so 'within a reasonable time but without causing significant inconvenience'.

    If the seller doesn't do this, you're entitled to claim either:

    A reduction on the purchase price, or
    Your money back, minus an amount for the usage you've had of the goods (called recision)

    If the retailer refuses to repair the goods, and they won't replace them either, you may have the right to arrange for someone else to repair your item, and then claim compensation from the retailer for the cost of doing this.

    Please note that 'reasonable' time for repair isn't defined but after three weeks I would write to them stating that if they cannot complete the repair within two more weeks you want your money back.

    You should also ask for a loan item, based on the lengthy repair time causing you inconvenience.

  • thanks for the advice - I'm happy with a repair or refund. I just want something back. it's 3 weeks on Thursday so will send another chaser e-mail

    is it worth getting paypal involved?
  • Its now been 21 days since they had the item back - I've sent them another e-mail asking what is going on.

    Should I just wait for 30 days and send the letter before action?
