Lowells / Dryden fairfax - CCJ help

Hi All,

I posted a while ago that Drydens had taken me to court over a balance i dispute from 6 years ago..

the advice at the time was to contact the mediation services, issue a subject access request and request all information that they intend to use in the hearing as well as request evidence of the balance.

I did this and chased them many times - however they refused every single point, whether i phoned, wrote or emailed they were all ignored.

the hearing was september 12th and i wasnt able to attend, the court wont tell me anything and i have not received anything from drydens.

I have received an email today though saying the following

"
A witness statement was sent to you and filed at the Court prior to the hearing which set out the claimant's case. An agent attended the hearing on my client's behalf and a County Court Judgment was obtained against you in the amount of £504.73, payable forthwith.

If the payment is not made in accordance with the Court order, it is likely that enforcement action will be taken."

I have never received a witness statement this is a complete lie.

What are my next steps to challenge this

  • i couldnt get out of my meetings at work, and i believed the fact i put in my communication to the court they refused to contact mediation, refused access request, and all other info that it would prove i made every effort while they made none..

    i forgot how corrupt this system is.

  • Well you need to contact the court urgently to find out if they did indeed get judgement.
    I'm not too sure if you can challenge it now or not. You could try the HMCS website to see if you can find a form to appeal.
    If you don't want to/can't contest it then you will either have to pay it or apply for a variation (ie to pay in installments).

  • so you filled N9b form then had, a hearing date then couldnt turn up?

    yes, the hearing was on sept 12th i had planned to get out of work but in the end i could not get out of the meeting i was in due to the nature of it.

    However, i have since contact tmobile (who dryden claim the debt is to) they have no record of any account ever being open - i then looked at my credit file and there is no reference to this account they talk about.

    I requested in may a copy of an agreement or contract and dryden refused, they also refused my subject access request and refused to provide me with information they were to rely on in court.

    they are continuing to refuse to provide a copy of a witness statement they claim to have sent and refuse to provide an account number, a phone number or any type of supporting document or reference.
