    OP the posts regarding the liability of the Landlady of the upstairs flat are correct.

    She is liable. If she believes that her tenants were negligent, then she may pursue them in court to recover her loss, and if the tenants feel the cleaning company is liable, they may do the same.

    From your perspective, the only person liable is the landlady upstairs. You must write to her, requesting a payment for your damages.

    Then you must write again, a letter before action, and then finally you should pursue this through court.

    Thanks for this, this is all I'm really wondering, whether she is liable as her attitude has been off from the start, it's quite clear she is in Australia and doesn't want to know, if we had contents insurance we would just contact them but where we haven't and want to take this up ourselves are we chasing her, the old tenants, the cleaning company etc.

    Put your efforts into chasing the owner of the upstairs flat and ignore the other people, thats just a distraction.
